1) Is he constipated.
2) Did his wife turn him down for sex last night.
3) Does he think their lawyer is a prick.
4) Judges prefer to make precedents, not break them. So if there's anything in the past to screw it up, he/she will probably find it.

Places like mininova and TPB are just search engines that are made for searching for downloadable material and provide more information on what that material is. What people search for and download is up to the people.

I hate to say, but the CRIA has the advantage by drawing this out and extracting legal fees from isoHunt until they can't pay anymore. I hope that doesn't happen, but I bet it's their plan.

It's the same in Google. I could search for "Download OpenSuse on Google, and I'd get a 100% legal download page; but I could search for "Dark Knight torrent" or "preteen sex videos", and get some pretty illegal results.
The point here is: are search engines legally responsible for the results they show? Is it technologically possible to examine every possible result before showing them? Should the search engines guess what is legal and what is illegal in the country where a user is?
Really, this decision is as important for Google, Yahoo etc as it is for IsoHunt. They all rely on the possibility of giving the best matches for whatever the user is searching, and on the idea that the legality/illegality of those results is to be decided by the user (and whatever consequences should be faced by the users and by the sites they go to, not by the search engine). - shnuffy, on 09/15/2008, -3/+2It's ballsy for IsoHunt to do this, but a good thing. They are effectively sealing their fate, for better or for worse. Their cases relies on technicalities and the full understanding of technology, and unfortunately most judges simply do not have that understanding. It will be on the lawyers to explain in great detail what torrents are and how they actually work if IsoHunt is to have a chance. I'm interested to see the outcome of this one...
