I'm not suggesting that it should be illegal in either (I say if you want to sell sex and someone is willing to pay then go ahead). But why is it illegal in most place?
Whoever wrote the laws that make things like prostitution and sodomy illegal would probably stand on just as invalid a ground to make those acts illegal in a virtual environment as well.

Publically soliciting sex for money is illegal, but if you take the person back somewhere and perform sexual acts for monetary gains determined afterwards, it's perfectly fine. So, sitting on a street corner and asking upfront for money to have sex is illegal, but picking up in a bar and getting the person to pay you to do something sexual is perfectly legal.
The correct term would be 'If -Soliciting Sex- is illegal in real life why should it be legal in second life?'
Virtual 'sex' is by no way illegal. Just look at porn. Millions of people masturbate to live videos or pre-recorded pornography every day. That's basically the same thing as paying to cyber with someone in Second Life. Politicians just dislike soliciting for sex because of what it brings along with it. Increased crime, destruction of neighbourhoods, heavy alcohol and drug dependance, STD epidemics, etc...
