I'm no lawyer but this wording is extremely vague and could be used to legitimize the distribution of your content via almost any vehicle in relation to Myspace, not just the site.
I'd suggest removing any original content you have there. Myspace bulletin board censorship is alive and well. I posted a bulletin about this license issue when Fox bought them but it never showed up then either. But there are some issues they're going to have to work out first. 1) The security guard that came said that he didnt want to see his face on merch. 2) the parents in the background may sue if their children make it onto DVDs for Pervs to buy and watch.

You can be pretty confident that once its on MySpace, they will have access to it even if you take it off soon after you post it. And by their terms, it doesn't matter if you take it down or not..it's theirs! *****! Now I don't feel as bad condescending to everyone I know about how stupid MySpace is.

Don’t you WANT to give myspace the right to distribute/copy/store/display your content? Isn’t that the reason you upload your content to myspace.com, so they can distribute it and display it worldwide?
Notice that the license to your content is “non-exclusive,” meaning you still retain your rights to it and still have the option of licensing it through other outlets. Also notice that it does not state you are granting myspace the right to SELL your content.
I think this license agreement simply explicates what is already the implied agreement for using a service like this. - colmore, on 10/12/2007, -1/+3The whole "having a public digital personality" thing is starting to weird me out. Of course we all do, but things like MySpace tie that personality pretty easily to your face, name, and friends.

- inactive, on 10/12/2007, -0/+2this has been going around for awhile and it's not really a threat. nearly every online user agreement requires that you promise them your soul but it rarely makes a difference. if myspace suddenly claimed up everyone's content because of some user agreement you click through, lawsuits would abound. remember that just because you agreed to the agreement, it doesn't make that agreement legal. it would easilly get torn apart in court.

I'm with all the sane people on this...that is, the ones that realize that this is a fairly standard claim in the TOS of a content provider. It does cleary state that "This license will terminate at the time you remove such Content from the Services." If someone distributes a low quality (and EVERYTHING is compressed and
lower quality on myspace) anything and expects people to buy it or use it in
anything even remotely high-profile, they're kidding themselves. Hold your
masters and the rest will be done for you. As long as you have those, you're
good. There's nothing in that agreement that states you have to hand over any
physical copy of anything. And if they try, they will lose.
The real question here is do you want Poopert Murdoch making peripheral
profits off your work in exchange for free exposure and file storage? And

- starmanjones, on 10/12/2007, -0/+1every entitiy has the same rules. if you use hotmail... the mail is bills. the thing is- its necessary for myspaces protection. we went round and round with people once because they were using hotmail to exchange a business plan and i was like... it ain't likely to be a problem but you mail that through hotmail and its they can have it. it was a big deal for a technicality. same with HIPAA... had some people using hotmail and its way not cool and you could loose your professional licence for using hotmail.
