Saying "a crime is a crime" is like saying "a murder is a murder". Of course a crime is a crime, the question is what defines an act as a crime and who determines that definition.

Granted this skews slightly from the most widely accepted definition of "criminal" and assessing whether actual harm was inflicted can be messy. That's because the literal definition implies everyone who ever committed a single traffic violation is a criminal (which conflicts with the standard notion of a person who commits crime as a way of life) and unless there is some sort of real victim (or malicious/negligent behavior that would very likely lead to one), it is hard to justify incarceration or labeling (IMO). - Iwantawii, on 10/26/2008, -0/+5Cereal.

Hackers do not necessarily commit crimes, nor infringe on the rights of others.
Hacker is a label given to people who think in a certain way. I am sure many Diggers have the Hacker mindset and don't even realize it. Kids, remove "hack" from your vocabulary. You don't know what it means. There are plenty of legit situations for cracking - pen testing, intelligence gathering, 'cyber warfare'. It's your motivation for doing it that is the deciding factor if you're a criminal or not.
