I can't think of any issues on which I disagree with the EFF which is why they are worthy of my yearly support.

- Kyzzyxx, on 06/18/2009, -0/+2I know the government tried to passed a law that all encryption methods have to supply a backdoor scheme that will allow the govt to read any encrypted document should they need to. Ironically, I was never able to find the results of that vote but I don't doubt it was passed. But I also have to wonder if they were able to actually enforce this as some encryption techniques were developed in other countries where they cannot enforce it. But, again, I wouldn't put it past those powers to want the same thing and work with the US govt to enforce it

Both parties use scare tactics to ***** us over, the only difference is the boogey man. For Bush it was the terrorists, for Obama its the economy (and the republicans). Obama and democrats in congress used the actions of bush and republicans in congress to get elected (and the republicans will do the opposite in a few years), but they have no intention of reversing the majority of these actions. I recommend sending all sensitive communications encrypted, but every once in a while send an unencrypted message that contains something like "so an agent stopped by and raped my cat today" or "that agent would flip out if he knew how good his mom handles a *****." If nothing else, the trial would be more fun!

The main difference is what extent they go. The gov't has been able to do this for a long time. Proper procedure simply requires that they serve the ISP with a preservation letter. This requests that the ISP not delete your data that they may regularly purge (such as deleted emails). This is especially done with dynamic IP addresses, since ISP's delete the logs occasionally (because they need to know who had what IP address at what time). Then they come with the subpoena for the info.
If they want to read your emails and communications in real-time, they still need a warrant. It is the exact same with phone taps. They subpoena your phone records to see where you called in the past. If they want what you are doing as it happens, then need the warrant for the Pen Register / Trap and Trace (two techniques that are just about always done together), and a warrant for the Title III (wiretap). It's a soft area, since the real issue is at what point does an email become real-time.
Phone records are easy to define as "past" but at the same time, they offer no "content" (e.g. exactly what was said during the call), unlike an email which offers content no matter what. The interception of regular mail without a warrant allows the viewing of the outside of the envelope. A warrant is required to open it (small fact: if there is unopened mail in your house during a search warrant, they can't open it unless that is specifically in the warrant). It's harder to minimize an email, but minimization is a completely different matter.
The SCA still requires a warrant for the gov't to read your unopened emails that are less than 180 days old.
Lastly the "landmark victory" only applies in the Southern District of Ohio. Every district can set slightly different requirements on what the gov't need to do or can't do to bring a federal case to trial. I won't get lengthy(er) unless asked, but let's say in Southern dist of NY, there is a rule about the perp walk that was deemed a 4th amendment violation, and was caused because of Fox news.
