There was a case just a few months ago where a soldier from Afghanistan was charged with CP for having some images of a 4yo relative in a bathing suit, images sent by the girl's mother.

Many laws get passed using this type of argument. Of course, such laws then grow greatly in scope. By then, it's too late to change the laws. One obvious one is that law makers are entirely unaware of the crimes they are making laws for, instead they listen to lobbyists(as in the case of music piracy for example) to advise them on what to do.
Another is that at the time these laws were made, an even smaller part of the population had any stake in those laws. Everyone is capable of getting drunk and risking peoples lives by driving dangerously. So not the pull towards lower punishment will be damped(although offset somewhat by the fact that more people can be injured by such a crime, admittedly). But how many people have the opportunity in 2000 to pirate music? Mostly younger people, and certainly not the majority of older voters. So the influence ratio of voters to lobbyists shifts even more in favor of these industries.

If they don't have any evidence for the real crimes they'll pile on the petty crimes until they get the bad guy off of the street. Al Capone killed or had some else kill probably hundreds of people, he went to prison 12 years for tax evasion. Remember law enforcement doesn't write the laws, but they will use them selectively to their best advantage. (Neither I, nor my friends, travel abroad very often, so the laptop search thing doesn't apply.) To be fair, most of them are related to circumventing drm or making copies of media, and one could easily break 4 of these entries in the span of a couple minutes.

Touching on your bigger point, we seriously need politicians who will work to change these types of laws, but unfortunately, nobody will because it's political suicide. Imagine the campaign commercials? This *is* government control.
Terrorism is just the current bogey-man and excuse for removing more freedoms. A little bit of government control is as nonsensical as a little bit pregnant.
