You're totally missing the point. He's not saying that manslaughter (your first example) and murder should be treated the same. He's saying that someone's motive for a murder should not change the punishment for a crime.
He's saying that if you planned to kill a person for a year because he/she slept with your spouse, and then killed them, the punishment should be the same as if your reason was because you targeted them because of their race/sexuality/ etc. - roosterjm2k2, on 10/11/2007, -27/+119Hate crime bills are just feel good bills.
2 Scenarios.
1: White man kills black man. Its very easy to turn the case into a hate-crime case based on race. Lets say the guy killed him over something simple, road rage or whatever, maybe he just lost it...doesnt matter. So he kills the guy...it doesnt take a huge push to turn it into a hate crime because of the difference of race.
2: White man kills white man who he honestly HATES. Not for race, religion, politics, he just hates the guy. Premeditated, has hated him his whole life. Its not a hate crime, because it doesnt fall into the pre-defined categories of hate.

Still, I don't think the laws are particularly effective, since I doubt criminals are thinking about the consequences when they commit their crimes.

Granted you could get much more specific than "hate crime," and insist it be called a "discrimination crime" or, if you want to be really specific "crime directed towards a homosexual person with intent to intimidate and harass," but hey, most of us just say "hate crime" and don't bother with all the unnecessary additions.
To say that that a crime is a crime is a crime ignores the effects those crimes have. Vandalizing someone's car with just some general symbol is certainly annoying to whoever owns the car, but vandalizing it with something derogatory aimed specifically at that person's race, sexuality, religion, or whatever has the added effect of intimidating that person, causing them to live in fear, and if the display is public, causing others of the same race, sexuality, religion, or whatever to live in the same fear.

It's easy to say that until you're part of a minority community that is terrorized by hate crimes. Hate crimes deserve special treatment because the motive for the crime never goes away.
1. White guy kills Black guy. The shooter says "He had a gun, and he was raising it toward me." That's not a hate crime. He was reacting to a SITUATION. The situation has past, therefore the motivation to kill has past.
2. White guy kills White guy. The shooter says "He was Irish, and all Irish deserve to die!" That's a hate crime because he was motivated by the PERSON HIMSELF. I've actually read arguments that homosexuality could be a species' own response to overpopulation. Given that we're at ~6.5B people on the planet, and that number's expected to hit 8.0B in 20 years, our species could procreate ourselves out of existence. I don't necessarily agree with the perspective, but people just need to get it through their skulls that not fitting in with perceived norms in a society does not make someone flawed. - JustAZombie, on 10/11/2007, -5/+20Yeah, but his point was ridiculous, given that the article was describing her emotional reaction to the crime. Treating hate crimes differently under the law is immaterial in this context; it was the motive behind the crime that affected her so deeply, not the crime itself. Here in Texas hate crimes are prosecuted separately from the regular crime. They're not just an enhancer. In terms of evolution, homosexuality doesn't really matter. Homosexuality happens in only about 2-4% of the population and individuals can still reproduce, even if the relationship is loveless. In a primitive world where producing a lot of children is top priority, humans can reproduce and raise their children without sexual attraction. For example that's why we treat pre-meditated murder more than manslaughter (we think the person who planned out the murder is a bit more of a danger to society than someone who killed through gross negligence).
