Madison in which the Supreme Court took the authority to review and invalidate government actions that conflict with the Constitution. However, this ruling placed the Supreme Court above the Constitution and its intent -- which was to limit the power of 'government'.
NO Constitution or law can work properly if INTENT is ignored. Let's face reality, if the INTENT of OUR Constitution and Bill of Rights had not been so skewed or ignored by politicians and activist judges, all the Iraqis would have needed to do was translate it into their own language. But they KNEW, so they spent months trying to write language into their Constitution that would prevent the abuses that had happened to ours.
We don't need a NEW Constitution, what we need are people in government who abide by Original Intent, not those who would circumvent every part of it to suit their own agendas. Term limits for ALL government officials may be a solution but since we must rely on politicians to change it, I don't know how to get the job done since they are surely not going to change anything that would be to their disadvantage but only to give them MORE power as has been done with most of the 'changes' added to the Constitution and Bill of rights by later Amendments -- all of which were crafted by self-serving politicians. - doUknowhim, on 12/12/2008, -11/+44Like I said in a previous post... The sentiment and mythology that encrust the relevant history, the comparison between Obama and Lincoln is an apt one, and not just because they're both tall, skinny men from Illinois (albeit by way of Kentucky in Lincoln's case, and Kenya – most likely – in Obama's).
Obama, a well-compensated legal agitator and foundation-connected "community organizer," straddles the narrow divide between collectivists of the corporate variety and those of the cultural Marxist persuasion.

The Emergency War Powers Act was instituted and superseded the requirement to govern under the Constitution. Every President since Franklin Roosevelt just signed the authorizing documents to continue enforcing the War Powers Act. The rational being that rule under the Constitution restricts the freedom of governance for the National Level. That is EXACTLY what the Founders believed and so clarified in the Preamble to the Bill of Rights. Thomas Jefferson indicated the same thing when he was speaking of the Marbury v. Madison decision.
