Regarding FISA and constitutionality of such:
Whether you agree with FISA legislation or not - and I'm still not convinced of the usefulness of it, nor am I confident that it provides sufficient restrictions against illegal surveillance - it has been tested in the courts, including the SCOTUS, and found to be constitutional. You can argue the merits, but at least recognize that.
Regarding illegal wars in Iraq and Afghanistan:
I agree that Iraq is fairly borderline in terms of legality, but Congress ultimately signed off on the action. Afghanistan, however, is difficult to quantify. In order to declare war, you must have something to declare war on. We are not at war with the country Afghanistan. We are conducting military operations against certain organizations within the country's borders. Declaring war is a lot more involved than you think.
Regarding the suspension of Habeas Corpus:
I think people are getting two things confused: habeas corpus and extraordinary rendition. Extraordinary rendition is the act of removing an individual from one country or state without due process, and transporting them to another location, generally for the purpose of "enhanced interrogation". While habeas can be and has been used to argue against extraordinary rendition the administration has already stated that this activity will no longer take place.
As to Obama's decision to allow for the suspension of habeas corpus in, for example, Bagram, it should be noted that there is a different situation there from Guantanamo. His desire to suspend habeas corpus is not a stepping stone or first step in detaining people forever - he simply wants them kept where they are until such time as a full investigation can be performed. He's coming into a ***** storm of improper and non-existent due process. His justice department needs time to investigate those held, and the evidence that is holding them, and make a decision as to whether they should be held or not.
I'm not particularly enthused about the idea of continuing to suspend habeas corpus, but I'm willing to cut him a bit of slack while he figures out what's what.
On to the Patriot Act, and whether Obama voted for it:
No, he did not vote for the original Patriot Act. Yes, he did vote to extend the Patriot Act. So why would he vote for it if he was so concerned about civil liberties? The reauthorization of the Patriot Act in the form of the senate compromise was a step forward for the Act as a whole. Obama believes that there are provisions within the Act that are worthwhile for law enforcement and national security needs. He voted to extend the Act because the compromise, while not nearly as strong on civil liberties as he wanted, was a solid step in the right direction. He did not want to remove the tools that the Act provided law enforcement.
Also note that the reauthorization included a number of provisions designed to limit potential abuse of the tools provided. It doesn't go far enough, but sometimes you have to take what you can get.
On funding the war:
You can be against the war while still funding it. What's the alternative? The military doesn't get its funding for Iraq, and needs to cut back. How do they cut back? By not committing additional resources, and removing resources already committed. Will that end the war? No, it just gives those on the ground fewer tools to work with. You would, in essence, be creating a more dangerous situation. A phased draw-down is what needs to happen - sooner rather than later - but a haphazard and clumsy attempt at ending the war by cutting off funding will eventually cost the US much more in the lives of US soldiers and Iraqi civilians that would a well planned exit. - arunforce, on 04/26/2009, -10/+26Old video is old. + it's been on frontpage already.
