If the situation isn't so dire that you'd risk unpardoned jail time after torturing a suspect, then that means your intelligence doesn't justify it either.

- inactive, on 02/13/2008, -1/+3First off, Justice Scalia's role as defined by the Constitution leaves no room for a Supreme Court Justice to "suppose" anything. This subject, like any other Constitutional issue that concerns the High Court, is not open for relative interpretation. It is as absolute as the law of gravity, a snow white and jet black issue. The eighth amendment strictly forbids cruel and unusual punishment. If Justice Scalia thinks inserting anything under any one's fingernail isn't cruel and unusual punishment I would hate to meet the Justice. If your paths should cross in a restaurant beware that you adhere strictly to proper etiquette. Failure to do so might result in a piece of stemware inserted in your anal cavity.
