Okay, this is from the actual Senate Judiciary Report:
"The court decisions reviewing executive privilege claims do not support such a broad scope
for executive privilege claims beyond communications directly involving the President."

It then goes on (I'll spare you" to basically say that they don't find that George Bush has immunity in this situation either, because he publicly (and often) stated that he had no involvement in the what led to the firings, and therefore there was no "communication directly involving the President".
So both President Bush and Karl Rove are probably going to be forced to testify or face contempt of court - which is jail.
The catch 22 of the law catches the catch 22 of Karl Rove and George Bush, which puts them in a catch 22!
