The law enforcement agency that would arrest Rove is directly controlled by Rove's boss G.W. Bush, the same guy who admittedly told Rove to break the law by refusing to testify before Congress.

They are able to send their own officials to arrest people who fail to appear for subpoenas -- due to what's known as "inherent contempt" of Congress. The president has the Constitutional power (at least as its been interpreted by the Supreme Court historically) to pardon someone for offenses against the United States at any time, even before a trial is concluded, even before charges have been filed. See Ford's pre-emptive pardon of Nixon for a famous example -- it was wrong but completely legal.
You should fully expect to see Bush issue a truckload of pre-emptive pardons on his way out the door, which will prevent justice from ever happening.
