With all the media coverage about "illegal immigration" I guess the word "legal immigration" means nothing.All the news outlets last week covered immigration debate but missed the biggest and most probably an illegal act of the DHS and USCIS to make the lives of people applying legally to immigrate to the US a living hell. On June 13th the USCIS issued the July visa bulletin advocating that the people who are applying for green cards under the employment based categories can send in their documents starting July 2nd,2007. Approximately forty five thousand people who have been waiting patiently their turn paid hefty lawyer's fees(avg S500/person) and medical examination fees(250/person), fedex(appx. $100) etc. So all in
all approximately between $750 to $1000 was spent per person.Do the math.
However on the morning of July 2 the DHS changed their mind and decided to reject all the applications indefinitely. So all in all the law abiding(tax paying) "legal immigrants" who were as it is stuck in buerocratic backlogs for years have been as usual taken for a ride again.The whole situation is smelling of a pretty huge scam to extract as much money and juice out of the legal immigrants because the USCIS knows that these people will not complain because of the threat of retribution(denial of green card) so lets screw them more.According to USCIS's explanation they had already received all the applications for the year in June. Well if that was the case then why was the bulletin issued on June 13 for the documents to be sent over the month of July starting Monday morning July 2,2007. Also why did the USCIS wait until the designated morning to revise the bulletin. If they had felt that the earlier bulletin was issued in error then they could have issued an update earlier. But the entire fiasco(atleast for the immigrant) reeks of a criminal scam. A lot of people have gotten richer in the process, ofcourse except the "legal immigrant" who was left bearing the bill of all this mess for no reason at all. Also the great USCIS realised that if they accept the applications after July 30 then they will get money under the revised fee structure.So the aim looks like to squeeze the last dollar out of the law abiding person.
AILF is already contemplating a lawsuit to be filed against this unlawful act however am not sure how many people will actually join the suit as plaintiffs for the obvious reason(what if their applications are rejected by USCIS as
retribution....after all without the residency papers you cannot stay in the US...and if you cannot stay then I guess the lawsuit does not mean much I guess.)So a pretty nice catch 22 trap has been created here which almost looks like a brain child of a criminal enterprize or its the height of inefficiency ever seen.
The only hope for the legal immigration system to survive in the country is if the media can be mobilized to prevent this grave miscarriage of justice. Otherwise the faith in the already broken system will be totally shattered and the message is pretty much in bold "Become an illegal and you will get it all"......after all 12 million makes a better soundbyte than 45,000.

The US doesn't owe you citizenship. If you want it bad enough, you should be willing to jump through the hoops to get it. There are many other countries where you can gain citizenship easier than here, so I suggest you go that route if your health cannot withstand the process it takes to gain citizenship. - ScornedPatriot, on 10/11/2007, -0/+1Oh yes I understand what you mean entirely. Diggers have been trying to show the inefficiency and criminal activities of this current administration for years now. A lot of good that has done. You LEGAL immigrants are not alone in feeling the US government is screwing you, WE ALL feel that way at this point. The government no longer does what the will of the people. I've literally been told at job interview lately that, even though I was a perfect candidate, I wouldn't be hired because they can have someone brought into the country for 1/2 of what I would make as a citizen to do the same job. Yeah it was really smart of me to go $60,000 indebt to get my Masters Degree, and now I can't find a job because I'm not cheap, well neither was my education. Yeah, now maybe you can see what I'm a little peeved.

LEGAL immigration. The only problem is, the legal pathway ***** blows for those waiting patiently in line to get in. And major aspects of the current work visa system are being blatantly exploited by unscrupulous corporations. Which blows just as hard.
What we need immediately is increased workplace enforcement. Now. A huge increase in fines and penalties for breaking ANY current immigration law is a must. Big, small, corporate, personal. No exceptions.
Then we need border security. Yes, I now the fence-by-itself is folly. But combined with troops, surveillance, etc, it will make a difference. And we cannot do nothing. It's as simple as that.
Then we need to address the LEGAL immigration system. Perhaps piece-by-piece, who knows? After this last major piece of legislative *****, it's probably smart not to tackle such a complicated issue "comprehensively". But the assinine shenanigans outlined in this article and others has got to stop. Because the irony of the whole "immigration debate" is that if we don't pay as much attention to LEGAL immigrants as we do to ILLEGALS, it's not going to work.

Unfortunately, the leftist hippies and their democrat politicians seem to prefer bending over backwards for illegals. The fact that the topic of immigration reform is even on the table, instead of enforcing existing laws, is proof enough. The resulting extra 12 million caseload from illegals will bury the already overwhelmed USCIS, which means the legals will get shafted. What's more, the illegals will demand to be bumped to the front of the line. They already demand to be given PR and citizenship. Next step will be to demand priority over legals who have waited patiently for years. Don't believe it will happen? Don't underestimate the mass delusion suffered by west-coast feel-good liberals.

- keegami, on 10/11/2007, -0/+0This is ridiculous. My friend came to this country from Japan 10 years ago on a Student Visa. She came alone, not much money, no help from family financially. She promptly enrolled in a University. She worked 3 jobs, lived in a cramped, and I mean tiny apartment. She didn't know much English upon arriving, taught herself through hard work and dedication. She graduated from said University with a degree in Food Science, her second degree, first was from Japan, Business Admin.
She has worked 6 years in the American food industry. Always having to find a company willing to support her Work Visa. (not cheap, for those who don't know) She has worked for Dole Foods the last 3 years. The company was so impressed by her work ethic and skill that after only 6 months on the job they decided to start the paperwork on her Green Card. The lawyers have taken care of everything, I'm sure it's cost Dole a pretty penny thus far. (she has paid nothing, the company is footing the entire bill)
Last week she received the packet from USCIS asking her to get all documentation together, physical exam, etc... and mail them back. She was excited, finally after patiently waiting all this time the Green Card seemed within reach. Yesterday, the lawyer called. "Green Card applications have been put on hold", he said. She was devastated to say the least.
She loves this country. She has worked hard, followed the rules, paid her taxes, waited in line like everyone else, only to have this fiasco of a rule change brought about.
Funny this should happen a week after the Immigration Reform Bill is shot down. Like someone previously stated, (roughly) "why bother going the LEGAL route, come to America ILLEGALLY, you get better treatment". All politics, it's disgusting.
BTW, I was born here, this mess makes my stomach turn.

Can you please explain why then are people pissed off? Am i missing something? - crocodilexp, on 10/11/2007, -0/+0USCIS is an agency from hell. I'm a son of a U.S. citizen, and had the green card for 5+ years -- graduated from one of the best universities, paid way above average in taxes.
I waited for well over a year for my citizenship application to be processed, without any status updates from USCIS. At the end, the only solution was to sue the federal government and USCIS -- this forced the cogs to move within a week, and solved the problem within a month. At least, the court system works. The U.S. Attorney (which was supposed to defend USCIS) almost always prefers making them do their duty and process the application, instead of going through courts and losing. Unfortunately, the legal remedies are much more difficult for green card applicants.
America needs to the smartest and most industrious people from all over the world -- it's what made us strong to begin with. Deny such people the opportunity to legally immigrate, and it won't be too long before we see other countries overtake us. - Cooperjones, on 10/11/2007, -0/+0This is Bush's payback for the people of the United States rising up against amnesty for illegal immigrants.
