they had NO business telling him to move along and he had EVERY right to tell them to blow off. (assuming the particulars in his story are accurate)
If you in a crime scene they can order you away. if your too close to an incident they can order you away. if your on private property they can order you away. if your were your not supposed to be (no stopping standing area) they can order you away othewise they should have just sucked it up and went on with there business. If he sues them... and it hits the 'net, we'll know with a relative certainty what really happened. My bet is they will settle out of court though -- for that exact reason (assuming the officers did do wrong).
The 'everything you say can and will be used against you' isn't just a joke. They get to use it in court because it's, more frequently than not, recorded. This is why it's /very/ important to remain calm and professional.
Cops can also lie... the VERY first thing you need to say to a cop when you get arrested "I'd like to speak to an attorney". Some will say that if you do that then they can not help you... do /not/ trust them in those situations. If it appears a cop has /any/ ill will towards you -- get an attorney and don't say another word. If, however, it's to someone else's crime or something that appears to not endager you (or something that can be manipulated to look like you did something wrong) -- then you may just want to full cooprerate. I'm a pro photographer that works for the media including huge agencies such as Getty Images (mainstream) and Splash Media (paparazzi style). And I've had my photographs published all over the world.
This past Saturday night there was a raid at a club i was shooting for ... and it was undercover cops busting underage drinkers. At first I didn't understand what was going on, then put 2 and 2 together quite quickly.
I then stood outside on the sidewalk about 200 feet back from the "undercovers" (they were dressed in plain clothes), and proceeded to photograph them. I was snapping away as fast as my camera would allow, and one police officer came up to me and told me I was not allowed to photograph them as they were undercover. I told him that actually he was incorrect, because we were in a public area (public road, and public sidewalk), I was allowed to photograph anything in public. He basically threatened to arrest me if I kept photographing, and I told him that if he wanted to test that theory, I had someone across the road video taping the entire incident and I'd be willing to test that theory ... all the while I was on the phone dialing my lawyer.. just in case.
This all happened within a 3 minute time period... as I truly did not want to go to jail, but the police officer (in plain clothes) did walk away once i said they were being video taped. I also did quit taking photographs from so close.. i just went back across the road and used my telephoto lens.
To make a long story short.. i hate cops that hide behind their badges ... and my old man is a police chief... truly.. i hate him too.
Oh, and i will be publishing the photos of the undercover cops. He can kiss my ass after being such a dick.

Arcele, I'm not one of those people who thinks all cops are bad. The truth is that I think most of them try to do their jobs as well, as fairly and as honestly as they know how. But these Miami-Dade officers are in obvious need of an badge-and-gun-ectomy. If what we are reading is even close to the truth then by definition what those officers were doing on a public street couldn't be a private matter. And in no way was the photographer endangering himself, the officers, the suspect, or anyone else. These cops are simply thugs. As long as cops keep getting acquitted of criminal charges when they use excessive force, it's going to keep happening.
I think sometimes people on the jury are afraid to convict, even if they think they're guilty. But those of us on juries have to make a stand when the facts justify the charges.
Some of my best friends are cops...I have a very cordial relationship with them being on the fire department. Given that friendly perspective, I can say most of them do a fantastic job. But there are some people in law enforcement who are in the wrong line of work. Others have been on the street too long and need a break. But positively if we don't put real safeguards on excessive force, then the only difference between the US and a police state will be the perception. I think it's already that way in a lot of places. We used to be able to count on the courts for protection, but that's been stripped away. Anthony Scalia says we can count on better police officer training to protect us. I don't share his optimism. Somehow if your dad is a good cop (and odds are he is a good cop most are) he would have been annoyed and NOTHING MORE by a photographer 60ft away taking pictures of him.
A police officer does NOT have carte blanc authority to give any order he or she desires. If your not breaking the law and NOT in the way you are in NO WAY obligated to follow a police officers orders short of not following those orders resulting in breaking the law (example if they say turn here for a D-Tour NOT following that order would result un a safety and or regulatory issue)
Thats it. the officers authority to dictate orders to me ENDS THERE.
AGAIN all this is based on him being 60ft away (MORE than far enough to not even slightly be considered obstruction) SO FAR based on the story I have read it seems they just did not want him taking pictures and decided to teach him a lesson for LAWFULLY disobeying there unlawful order.
CLEARLY whoever they were questioning was not THAT IMPORTANT since they all LEFT him to come beat up the camera guy.
I once had a copy tell me to stop video taping them taking down a guy who hung himself. they were ACROSS a canal I was in my back yard. I knew I did not have to stop but I did anyway and proceeded to record it with my 10x zoom from inside the house and smiled at the officer when he glared at me :-) When he first came up to me (40 ft across the canal up to me at least) he said what are you doing. I turned the camera plainly visible sideways to him and said "huh ? what does it look like I am doing.?" (not with an attitude more with a matter of factly duh kind of demeanor at this time I was still naive enough to intrinsically trust cops)

True, however i checked the Miami Dade requirements through the online job postings. They only require you have a high school diploma, and are able to see.

I used to work as a newspaper photographer in college, we were always told to stand our ground against the police, as long as we were in a public area, you were allowed to take pictures as long as you identified yourself as a journalist. Maybe that would have been the best course of action considering that he did get beat up for not ignoring them, but is this right? Is it really freedom of the press. If every journalist simply moved along would any sort of brutality ever be recorded and written about. For God's sake they smashed his head against the pavement, simply for standing across the street, watching what they were doing and taking pictures. I mean how free are we really.

Let me explain something about cognitive dissonance. Basically, what that means is that probably (I don't know for sure) you have a certain view point about this country and about the police (i.e. if someone gets slammed by the police there is probably a legitimate reason) which is being challenged by a report that says other wise. These are two conflicting views that simply cannot stand together in the mind. You have two options in handing these two bits of information. 1) Change your original viewpoint. 2) Ignore, misinterpret, or deny the new viewpoint. One of the best ways to do the latter is through character assassination. Thus, the rationalization that the reporter is a bad reporter, is lying, etc. is simply the minds protection against cognitive dissonance. The fact that he misspells in his story has more to do with the fact that he is posting on a message board, is probably very busy or hell he might just be a bad speller, but it has nothing to do with the validity of his story.
But here is the fact of the matter based on numerous well-known pieces of evidence. America is becoming more and more a fascist nation. Not quite there yet but well on its way. Police brutality is just one piece of evidence. Hyped up sentencing (as numerous recent articles on digg have shown) torture, extraordinary rendition, war on drugs, secret wiretapping, the media consolidation by the MSM, all of these are evidence of growing fascism. I'm sorry that it hurts to be faced with these facts. But please be honest with yourself. Attacking the messenger (as I'm sure I will be) is not a valid argument.
