I mean I do not know what is going on in the investigation, and frankly don't really care, I am just wondering what the law would be if I was subpoenaed to disclose my emails, someone hacks them, and then the information is used against me in a court of law, would they hold up?

The password wasn't 'hacked'. It was reset. Yahoo! has you answer some simple questions (dependant on what you choose), and the password is reset. A 12 year old with enough information could do it.

Even if they managed to control all 3 points along the Tor path, and manage to track down the exchange to the Starbucks, you're not getting caught unless you actually went inside the Starbucks and got captured by the camera. Regardless, this was a pretty lame move. If Anonymous really wanted to matter in the race, they would have kept and expanded their access, and waited until there was legitimate dirt. The woman used a public, free email service to conduct government business. In most companies you could get fired for it (my company has an EXPLICIT policy against this). Some parts of the federal Government would put you in prison; in some cases it's a felony.
It was inappropriate to hack her account, on that I agree. She is still sidestepping. However, they forgot that this was the e-mail of a candidate for the VP of the United States. The reason people don't normally get caught is because it usually doesn't warrant the use of every available tool to track them down. That's not going to be the case here. And, it's far, far easier to track this stuff down when you are the US government and don't have to worry about pesky legal issues.

If you gain access to an information source you don't change the password, plaster 15 minutes worth of screenshots saying "look what I did", and then hand over access right back. The group that hacked MediaDefender did a much more thorough job than these guys. Seriously all they did was show that Palin uses personal email accounts for government work. Guess what?
