Are soldiers going to be expected to read Miranda warnings to terrorists they capture? What about collection of evidence? As much as I might disagree with torture, I think we ought to consider very carefully what our future policies are going to be before he makes a decision like this.

In fact, I'd venture to guess that since the torture scandal was made public years ago they have been exceedingly careful to respect human rights. The issue is the lack of credibility of the military trials there, and the fact that every prisoner there has already been detained without rights for years. Closing Gitmo = actually taking responsibility for those held there, as opposed to locking them away and forgetting about them.

- Billions, on 01/22/2009, -2/+30Likely those detainees and future detainees will be held in more standard U.S. prisons on U.S. soil, subject to legal treatment under U.S. law, which is what Obama wants to represent to the world - the U.S. will do things correctly. Gitmo has been a grey area where strange 'un-American' methods could be used.

I think a lot of the point is that without any charges or trials, it's not even certain that some of these guys ARE terrorists at all. They could've just been at the wrong place at the wrong time when they were taken prisoner. There are examples that innocent people actually had been held there for years. And frankly, I can't understand why we wouldn't want the Constitution to apply to non-citizens. Otherwise, the government would have a convenient loophole - detain you, question your citizenship status, and then deny you a trial - you'd have no way to contest their ruling that you're a non-citizen, and they could detain you indefinitely with no justification. - Stap1eGun, on 01/22/2009, -5/+18Why is everyone saying "it's just talk it doesn't mean anything" whenever Obama does anything?
