Read my post again. Don't put words in my mouth that I never said, such as words to the effect that only appellate practitioners can criticize Justice Thomas. Of course, since the US Supreme Court is an appellate court, the highest appellate court, appellate court practice experience just might come in handy in the assessment of the legal skills of sitting justice.
Oh, that brings to mind a couple of more questions any first year law school student could answer immediately: By what pleading(s) does one seek Supreme Court jurisdiction on appeal? Beyond appellate jurisdiction, does the Supreme Court have jurisdiction over any other matters? If so, describe the scope of that jurisdiction. If you want to criticize a sitting Justice on the basis of his legal skills, knowledge of that Court's jurisdiction is absolutely fundamental. You have to know that to know if the petitioners have any right to relief from the Court in the first place.
C'mon Mr. "Top Ten Law School JD"! Every single question I have asked you is simple first year law school stuff. Which "top ten law school" gave you a JD? I may not be as smart as I think I am, but I do know a couple of things for sure. I'm smarter than you are. And you are no "top ten law school" JD. Or any law school JD.

It is indeed presumed to cause damage to reputation, but that is only part of its legal significance and consequences. For example, you ignore its consequences in the assessment of damages, which are manifold. In this day and age accusing someone of being a coward or having syphilis might be actionable per quod (you look it up) but I question whether either is actionable per se. State law is not consistent, but there are a number of examples of statements that are universally considered defamatory per se and you did not use any of them.
Your definition of actionable is wrong. Hint: Defamation per se is always actionable, simple defamation is not. Damage to reputation does not, in and of itself, necessarily result in actionable defamation.
Your notions of what constitutes an identifiable person are also wrong. I am identifiable here, as you are. I have a reputation here, as you do. That reputation can be damaged by defamatory statements, and damage is presumed as a matter of law in the case of libelous statements such as those you made.
By the way, we are still waiting on your discussion of the differences between a subpoena duces tecum and a writ of habeus corpus, any shred of evidence that you "got a JD from a top ten law school", ever practiced law (not to mention appellate law) or any other evidence that you are qualified to express a credible opinion on the legal skills of a sitting Justice of the Supreme Court.
That is how this discussion began. And you could easily prove your claim that you "got a JD from a top ten law school", if indeed that claim were true.
