The Constitution appoints the president the Commander in Chief. The constitution does not place any limits on the president's discretion in employing the military. A declaration of war is not a prerequisite of military action nor is there any limit to the scope of that action.
The reason the executive branch exists is to react quickly to developing events, something that congress, as a deliberative body, is absolutely incapable of doing. Any law that forgets this is an abomination. Attempting to limit the executives ability to do it's most fundamental and vital job is an attack on the very foundations of our system of government.
The fact is, the congress does NOT have the authority to tell the CinC what to do with the military.
