In his absence, the senate elects a President of the Senate Pro Tempore. It is true that the VP is handled a little differently than other members of the executive. However, if the VP dies a new one is appointed by the president (and confirmed by both houses).

The VP's role in the Senate is analogous to the President's role signing bills. Just because they both (gasp!) are involved in lawmaking doesn't make then part of the legislative branch. He was just a convenient person for those votes when they need a tiebreaker.
The second part is that if Cheney's not part of the executive branch, then he should not have any classified intelligence access, offices, etc. I mean, why is he even drawing a salary if he's not part of the federal government? Which takes precedent, his role as President of the Senate, or his role as a member of the Executive as VP? If the first, then he should be subject to the infosec rules of the Senate. If the latter, then he is subject to the Executive, and therefore must comply with the National Archives Oversight. He's currently using his role as VP in the Executive to gain access to materials restricted from the Senate, but then trying to claim his role in the Senate as exempt from the rules that gave him access to the materials in the first place. Essentially he's trying to break the classification security model and create a covert channel for information to flow from a high to low security zone. Attempting to subjugate the classification system could be viewed as a national security risk...

The VP is only referenced twice in Article I (the Legislative Branch) of the Constitution (once to describe the tie breaking vote, once to describe impeachment proceedings) while the position is detailed in Article II with 6 mentions. These buffoons will believe ANYTHING that Bush, Cheney or O'Reilly tell them. Please.

- GoatBn, on 10/11/2007, -1/+5you may be right, but Bush's amendment to the Executive Order gives Cheney the right to classify and declassify materials, which means that he should have to follow the regulations in place, executive or not. The ISOO is not here to monitor Executive Branch, but instead there to regulate classifying of documents.
And why would cheney have no problem with this in 2001 and 2002, but as soon as the war started he wont cooperate with investigators.
