The entire checks and balances system built into the Constitution is there to maintain three, separate, and roughly equal branches of government. Letting anybody be a simultaneous member of two of those branches defeats separation of powers, which is a central design element of the US government.
Again, it's also a weak argument to say "because I break ties in the Senate, that makes me a member of the Legislative Branch, too." That's the only thing he does in regards to the Senate, and the only time he votes. If his regular duties included presiding over the Senate, or if he voted regularly, I could see the point, but he does neither. He only presides over a handful of ceremonial functions, like swearing in new senators, or to break a tie. Day to day oversight is provided by the President pro tempore (currently Robert Byrd), and even he serves a mostly ceremonial function, with junior senators generally rotating through the de facto position of presiding. The ONLY time the VP votes is to break a tie.
The only time he's mentioned in Article I is: "The Vice President of the United States shall be President of the Senate, but shall have no vote, unless they be equally divided." He's not mentioned in Section 3, Clause 1, where the composition of the Senate is established, but he is mentioned in Article II, Section 1: "The executive Power shall be vested in a President of the United States of America. He shall hold his Office during the Term of four Years, and, together with the Vice-President chosen for the same Term, be elected, as follows:" so he's explicitily a part of the Executive, and both the separation of powers and that he's only mentioned in Article II as a tie-breaker makes him a member of the Executive, not the Legislative. - ryodoan, on 10/11/2007, -2/+6where did the block button go?
