I have no problem with incarcerating terrorists, but holding men without giving them the opportunity to prove their innocence is just wrong. Gitmo will never be an even remotely nice place.

If these guys are soldiers, albeit irregular ones, then they can be detained for as long as we wish. If they are not soldiers, then they are civilians who took up arms against us, and as such, they should be tried for war crimes, and punished by us, and only released to their home countries if we can be certain that they will be imprisoned when they are repatriated.
If we cannot be certain that they are not going to be held by their home country, and not take up armes against us again, then they should be held forever.
Whats more humane? imprisoned forever at Gitmo, or sent back to Yemen so they can be shoved into the jihadi meatgrinder? Strapped up with a bomb belt or sent into combat against US marines, they are certainly going to be dead if we let them go.
