Ron Paul and the Judge are 100% correct on this one. It's amazing how the worst presidents of all time, Lincoln and FDR, go down in the "books" as two of the greatest. I like this guy. - Xevec, on 12/28/2007, -5/+27First off, even though I am a supporter of Dr. Paul, he made no appearance in the video. About Andrew P Napolitano(the speaker in the video), he is by far one of my favorite lawyers to hear from. This guy truly knows about constitutional law.
Just to note about Dilorenzo's book "the real lincoln" it is one of the few books that is actually critical of lincoln. You can not find another book that is critical of him. It goes to show you where historians are biased in the sense of abraham lincoln. I am personally shocked about the digg comments, and how people are actually becoming critical of lincoln.

The commerce clause is meant to keep the dealing between the States fair and equatable. It has NOTHING to do with most of what Congress has been using it for. In their interpretation Congress has complete and absolute authority to do anything it pleases...Your assessment is correct. The Constitution recognizes our unalienable rights. The Constitution doesn't spell out everything. Any thinking person can tell what those are. What forbids the government from charging you a poll tax? The fact that all men are created equal. By taxing me to pay for your public services by the federal government, is pure and simply wrong. Other than the defense of this country, and the courts, our tax dollars are doing the work of the socialists.

...the real question from the civil war that historians and politicians are too scared to ever address is this...Is it ever worth it to destroy our own constitution in order to save it? because in the 1860's, our constitution officially failed.

Lincoln blatantly violated the Constitution when he single handedly suspended it himself when congress was out of session. BTW, my son did a AP US History on Lincoln. I suggested he do it on Lincoln being the worst president in US History. The class and teacher finally came to the conclusion the Lincoln, even though he trambled the Constitution was still the best President because he had done it to keep the Union together.

Important to understand: The Federalists supported a national government. The Anti-Federalists supported a federal government. Compromises created a hybrid Constitution. According to James Madison:
"The proposed Constitution is, in strictness, neither a national nor a federal constitution; but a composition of both."
The Federalists argued against a Bill of Rights on the grounds it was not necessary, that any powers not specifically enumerated in the proposed Constitution were inherently denied. The Anti-Federalists agreed on enumerated powers, however the Anti-Federalists did not trust the Federalist's argument. The Federalists favored an active bigger government - a national government and the Anti-Federalists believed the Federalists would eventually attempt to expand the central governments powers beyond enumeration and reject limitations on power without a BOR. Additionally, future generations may not understand that any power not specifically granted was inherently denied without a BOR.
The Federalists countered with the argument: if we list certain Rights in a Bill of Rights, then it would appear only those Rights, instead of all Rights, were protected. Non-enumerated Rights could eventually be assumed and destroyed by government. So, an eventual compromise was reached with the 9th Amendment to protect non-enumerated Rights:
"The enumeration in the Constitution, of certain rights shall not be construed to deny or disparage others retained by the people."
And the 10th Amendment closed the loop on enumerated powers:
"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." -
