I do not care for Rush, but he can say what he said. It is not treason since he is defending the Constitution. The government does not equal the Constitution. We the People and the Government signed the Constitution as our contract to form a Union. If one side breaks the agreement, then things need to be settled. Arguably, while the government spies on us and imprisons us without due process, then it is clear that one side has broken their agreement. What Rush said is ok and not treason. It is not treasonous to defend American and its Constitution against its government.
Patriotism is defending the Constitution, not the government. They are totally different things and the Constitution was created to PROTECT us FROM the Government.

Last week there was a HuffPo story on Digg in which Rush was quoted as saying that Governor Sanford was cheating on his wife because he was just so fed up with Obama. I happened to be listening to Rush (something I rarely do, only out of curiosity) at that moment, and he was definitely kidding. He obviously was not suggesting that Obama is to blame for Sanford's affair.
