I can't see any way that Rove could think that executive privilege could ever had applied to his dealings with the president. This is nothing but using what is an uncomfortable situation for whatever political gain they can get from it. Executive privelege goes all the way back to George Washington, and just as it is today, it was very controversial then. I don't think Rove has the ability to claim it though. Firstly, he isn't the executive, so how can he claim a privelege he doesn't have. Second, his executive isn't in power anymore, so how can he claim it?

The sufficiency of any executive privilege claim here is questionable and disallowing it does not limit the future exercise by those who could otherwise sufficiently make the claim.

In August 2007, Bush invoked "Executive Privilege" for Karl Rove rejecting a subpoena to testify before the Senate Judiciary Committee in a probe over fired federal prosecutors. White House Counsel Fred F. Fielding, claimed that "Mr. Rove, as an immediate presidential adviser, is immune from compelled congressional testimony about matters that arose during his tenure and that relate to his official duties in that capacity. Rove is still claiming executive privilege to avoid a congressional subpoena. Rove's lawyer writes that his client is "constitutionally immune from compelled congressional testimony."
It gets on shaky ground to claim "constitutionally immune" because the concept of executive privilege is not mentioned explicitly in the United States Constitution, but the Supreme Court of the United States ruled it to be an element of the separation of powers doctrine, and/or derived from the supremacy of executive branch in its own area of Constitutional activity.
Once invoked, a presumption of privilege is established, requiring the Prosecutor to make a "sufficient showing" that the "Presidential material" is "essential to the justice of the case" and would most effectively apply when the oversight of the executive would impair that branch's national security concerns.
This essentially puts the Executive Branch in direct confrontation with the Judicial Branch. The Judicial Branch was certainly "watered" down after former U.S. Attorney General Alberto Gonzales finished with it.
Wow. They came so very close to dismantling everything that the founding fathers built. I guess the key word here is --- Privilege. Privilege is not a Right.

When Ford pardoned Nixon, he claimed that our national nightmare was over. This made him a far worse crook, and hypocrite than Nixon.
