O'Connor said that men and women make equally good judges. Sotomayor says that a Latina women would make a better decision than a white man. There is a big difference from saying hey, I'm Latino, I have a different background and history to draw on, so do you, we will both make good judges, and saying, hey I'm a Latino women so I will make wiser decisions. I don't know if I would call her racist or not, but definitely conceited. I don't think she has any more or less of an agenda than any other Supreme Court nominee, but I don't know that I'm comfortable with someone who is either dumb enough to publicly make those remarks, or conceited enough to believe them and not think there is anything wrong with them sitting on the Supreme Court and setting case law for the whole country.

I don't really see the big deal as she was talking to crowds of women/minorities at the time and said it in an attempt to inspire, but using that to inspire is wrong on several levels. At least thats what NPR has been telling me for the past two days.

Now imagine that this group of firefighters was made up entirely of minorities and tell them that they will not be awarded their promotions because no Caucasians were able to earn the same scores.

I am glad that both parties apply great scrutiny to any nominations so as to prevent bias on one side or the other. Don't get me wrong, I thing certain media outlets need to find a new story, but I'm glad that she was brought to task by the committee for what she said.

Alito is saying he takes past experience into account when arriving to a decision. Such a thing is implied whether it's spoken or not. All decisions are made through past experiences.
Sotomayor EXPLICITLY stated that her experience are worth more than another persons simply because of her sex and ethnicity compared to anothers sex and ethnicity. That is racist as hell.
If a white judge had something like "I would hope that my rich and varied experiences as a white man would lead me to better decisions and conclusions that a black woman." Obviously no one is criticizing Sotomeyer for simply looking to her background I think what people take issue with is the fact that she feels that most of the time she'll do better than a white male. While in some cases I think it would be true, I think it doesn't resonate truthfully regarding all issues.
