- rewinn, on 05/11/2008, -0/+10In most states, the victim's testimony alone suffices to establish that sex occurred and was non-consensual; it's a question for the jury to decide whether to believe the victim or the defendants. When the jury has to decide, the fact that the rape kit was destroyed is important evidence for deciding what happened.

When you're signing something that says you agree to arbitration it's usually for minor things. Rape cases should not be a case for arbitration. Someone has to pay the arbiter. I wonder who that might be, and where their interest lies? Arbitration is also a means to hide problems from the public eye, and to keep details of big problems out of the public record. - inactive, on 05/11/2008, -1/+9There have been enough rapes at KBR that were systematically covered up with identical managerial steps that indicate knowledge at the time. She will only be awarded money if it can be proved in a court of law that Kellogg, Brown and Root were aware of these rapes and encouraged their cover-up. Nice try, trying to minimize the crime and draw attention to the victim's supposed "greed."

Than that will give way to the criminal trial of the three men who stand accused. Still strikes me as funny that we are even in Iraq destroying the ***** out of it and rebuilding it with US tax dollars. If we stop destroying Iraq we save not only the cost of knocking it down, but that of the rebuild cost, plus we save horny soldiers and contractors from raping and killing eachother...Go figure!

I would imagine that if there is enough testimony and remaining evidence, obstruction of justice charges will be filed at some point.
If I were in her place, I would be concerned with witness intimidation, and I'm sure she also has been a victim of it herself. What you would call locking her up for a day after she reported it if you didn't call it "intimidation"? Frankly, I'm not sure I would have the guts to pursue the case - she probably already has to have security on top of the fear she already had from being drugged and gang-raped. Win or lose, she is going to be a marked woman for the rest of her life. The enemies that she made have already shown themselves to be vindictive. - Caffeinate, on 05/11/2008, -0/+2This is what happens when we stop giving a damn about anything that doesn't "directly affect us". It wasn't your wife, your daughter, your sister, your loved-one, it was just "somebody else". As long as there are enough people to repeat that "she's in it for money" and "we don't know what happened", it can be blown off as "somebody else". We *should* care, and we *should* find out what happened.
I don't think there are too many women that would choose to be gang-raped, drugged, falsely imprisoned, then forced to go through the shame of a very public trial to make a buck. At this point, I'm pretty sure she is just trying to make the best out of a horrible situation, and that takes courage - courage that men who drugged a woman, savagely raped her and then tried to cover it up do not possess. I'm not surprised by the childish comments of some here - it takes courage to recognize when a wrong is committed, even if it is committed by people you support, because then you might have to re-evaluate why you support them.
Until there is accountability for criminal acts no matter who commits them, as a society we enable and encourage them. Any other woman that had a similar thing happen to them will see how much shame, anguish and fear this woman had to go through to even be HEARD. She hasn't gotten any bit of justice yet - she is fighting to have the people that attempted to cover it up and silence her even hear her side of the story.
When you have to fight that hard to even get someone in the court room after there is evidence of a grievous crime, that is a symptom of a major problem. I think any time the subject is a CRIME--something not allowed by law or in this case even human decency--"arbitration" should be THROWN OUT. I don't care what she signed. Lawyers are excellent at twisting wording in documents like this and making them fit their clients needs any which way.
