That means they can do their wiretap at the drop of a hat, they just have to apply for a warrant within 3 days. The ability to wiretap without a warrant entirely is designed specifically for abuse; it has no real purpose other than avoiding oversight, which is in place to stop abuse and nothing more. It's not like it's hard to get a warrant - "we think this guy is a terrorist" is enough. They don't like it because many judges would have issues them using it against american citizens involved in positions of power to obtain blackmail material. That is the sort of thing that won't get you a warrant.

The big difference with the PA is that they no longer require oversight or judicial review. So if they wanted to spy on a political opponent and abuse that information, there would be no consequence to doing so. Adding oversight just means if the system is illegally and unconstitutionally abused, then those who do so will most likely be caught and have to answer for their actions. Affairs that are legitimately of national security importance should be uneffected.

But since a couple months ago that report came out saying that the VAST MAJORITY of all uses of the patriot act were not properly followed through, that procedure were not followed, and were not terrorism related... I think they blew their chance.
