Removing even one child from parental custody is a very serious matter that should require convincing evidence that there is immediate danger before a warrant can be issued. Anything other than that runs afoul of the fourth amendment.

I hope Texas finally sets an example for We The People and that enough of the rest of us follow in their footsteps of making serious efforts to reclaim our country instead of just talking about it!

Whereas Texas 51st District Judge Barbara Walther has violated the constitutional rights of more than 400 children and their parents of the Fundamentalist Latter Day Saints Church (FLDS); and whereas Judge Barbara Walther took an oath to defend and protect the Constitution of the United States and the Constitution of the State of Texas and has violated that oath; and whereas both an appellate court and the Texas Supreme Court have sided with the FLDS children and their parents against Judge Barbara Walther;
and whereas the actions of Judge Barbara Walther have resulted in a great financial cost to the State of Texas and its taxpayers; and whereas Judge Barbara Walther's actions constitute one of the greatest violations of constitutional rights in the history of the State of Texas; and whereas Judge Barbara Walther should have known ahead of time that what she was doing was unconstitutional, since the Island Pond Raid in the State of Vermont in 1984 was almost identical, and there are other similar cases on record where judges refused to support unconstitutional raids by Child Protective Services; and whereas Judge Barbara Walther has impeded the reunification of parents with their children, even after the Texas Supreme Court ruled that they should be reunified; we ask that proceedings begin immediately for the impeachment of District Judge Barbara Walther of the State of Texas.
This IS where we MUST BEGIN! - AThoughtOrTwo, on 06/04/2008, -1/+14Freedom OF religion means you can practice whatever tomfoolery you want and CPS should STAY THE HE!! AWAY. At most, only a VERY FEW of these children were in any "imminent danger" - they only wanted to terrorize them and get some "confessions" going. Why else take small children, split families and even take NEWBORN BABIES?
I've read where one couple (in a monogamous relationship) have four children at the four points of the compass in Texas? WHY WOULD THEY DO THAT? - nippinawassee, on 06/04/2008, -2/+13When they get through with the judge, all states need to investigate the actions of all child protective services (CPS). This is a state organization and like most state organizations it has to prove it is necessary to get increased budgets, etc. Now how would a CPS prove they are a necessary/vital organization to the state? By how many cases they have in their files. Never mind that not all accusations against families regarding their children are proven 'child abuse' - all are labeled as such. The system involves having 'foster' homes and are paid an amount per child per month for the abused child's care... This amount would vary according to the state's allotment. Taking in foster children who truly have been abused is a big job - children vent frustrations and fear on others - many children have been molested but they are put in with all ages, and all problem children. Putting children under one year of age into a home where there are male teenagers is not very intelligent BUT because of the problems associated with fostering children, too many of the foster parents are not exactly in it for the welfare of the children - the $$$ is the leading reason. Children aren't receiving the type of care, intelligent care, that they need in these foster homes. Children have died in the care of a foster parent who had TOLD the CPS that she was on medication for bipolar problems - she decided to go off the meds for whatever reason and a 16 month old child was beaten to death as a result. Too many of these CPS agencies are poorly staffed - agents 'in the field' are poorly trained if at all. I was witness to one such incident where the agent showed up at the home after working hours - would show up at 7pm, 8pm, 9pm - and reeked of alcohol. It's a system that needs a closer inspection - after all, how would a CPS field agent strive for a better merit review? By how many cases he/she brought in to CPS, right? How else would a state agency such as CPS prove that they were an important part of the state organizations? Abuse is in the eye of the beholder. A child getting a swat on the behind for misbehaving in a grocery store should not result in having the police waiting for her when she leaves the store - ALL with the very unprofessional help of someone who happened to think that swatting a child on the behind was cruelty... So a parent is arrested, the child is taken to CPS to be put in a foster home that could be as filthy as some in this area, and the parent ends up having to defend themselves against the accusation of an individual who has appointed herself/himself as the guardian of all children. This parent is then stigmatized the rest of his/her life because once an investigation is done, their name is forever on the state list of 'possibly abusers' - this list is available to all agencies who do background searches, which means a lot in this day. Wasn't charged officially? Doesn't matter... So something needs to be done about all half-baked judges BUT something needs to be done about the source of the Texas problem and that is the over-reaction of the CPS employees - it's almost like a party for them - imagine! We get all these cases, all this publicity as to how we are guarding the welfare of children and ALL on an anonymous phone call with NO PROOF - NO NOTHING. THAT is the problem with CPS agencies - they never investigate anything before they go roaring out the gate... after all, this will look good at our merit review... And then they had to take pictures of the parents and children - had to have official orders that they could not leave the state - could not do this or that without getting permission - they want to continue to keep tags on these people who have done nothing illegal, nor have the children been injured in any way other than not being raised in the filthy world we have allowed to be created. Wonder how the Texas CPS agency officials feel about that now? The CPS agencies throughout the country need to be closer supervised as to their tactics, their attitudes and their vindictiveness when they start one of these uproars and then cannot succeed because after all the bulls--t, there is NO CASE... that's when they tag on all these orders that the parents MUST obey... The only good CPS agent is one that is buried...

Our justice system is not even following its own laws so I guess its up to the people at large to take care of that problem. And therein causing another problem. This is such an emotional issue that mob mentality has already reared its ugly head. Notice how many people are already calling for this judge to be hanged. Hanged for god's sake!!!!!!!!
What this judge did can only be considered a while collar crime in this country. Yes this judge made a huge error in judgement, however does that lack of judgement warrent death? I think not. Impeachment and disbarment from the legal profession from life is punishment enough in todays economically uncertain times. It will certainly take this ex-judge several years to retrain for a new profession and during that time they may mingle with intellectually active people of a different generation that will open their minds to things they never even imagnined before. Death would stop this from ever happening.
I certain support never allowing this person to be the judge of any case ever again but i cannot support the wholesale slaughter of someone who without further evidence cannot be proven acted in a malicious way. Who acted on their beliefs and who in the end caused no harm in the grand scheme of things.
We allow people who drink and drive who kill someone out of jail after as little as 2 years and you want to kill a judge for making an error in judgement that caused no lose of life.
You people who want to hang this judge need to sit back an really look at what your asking for. You are disgraces to the modern civilized human being. There are so many things that can be used rather than killing those who offended you.
With all of this said, CPS has been given to much power considering they have no actual place in the justice system of our country. Many children who have been taken from their parents for no reason should be treated as any other amber alert would be. A child has been kidnapped by an adult and someone in the police department needs to deal with this issue immediatly. CPS should not be allowed to remove children. They have not been trained as police and as far as I am concerned have no authority over us in any way shape and form. Do whatever you think is necessary to protect your children from these people. There have been way to many investigations into the corruption of these agencies to just passively react to their intrusion in your life.
Just doing a google search on cps workers charged with sexual abuse of a child will at this time give 218,000 results. many of those are not actually on topic but enough of them to show a problem exists. The best thing if this happens to you is to get a lawyer before the child is out of the house. The list of judges in need of impeachment is miles long. Until the judicial branch is held accountable for their actions, this country will continue in it's current downward spiral. Hopefully someone will file criminal charges and get her in front of a Grand Jury.

I firmly believe that CPS in any state, does more harm than good any more. Mostly because of the reasons you gave and NO OVERSIGHT. They answer to no one except some judge who is also on the payroll of 'social change.'

That is the hypocrisy of this entire episode: Vanity Fair can post suggestive and semi-nude photos of a lipsticked, 15-year-old Miley Cyrus to great media fanfare and approval, while FLDS girls the same age wearing ZERO make-up and FULL-LENGTH dresses are ripped from their families. The difference: Religion. In other words, wreckless, secular sex is fine -- even at 15 -- whereas, Christians getting MARRIED in their teens is now a crime. Remember: In Texas, a 16-year-old may legally marry with parental permission.

Of course, it's much harder to find cases of lesbian teachers seducing their female students than it is to find cases of heterosexual teachers seducing young boys.
