If 'other women' (presumably 3 or more) have come forward with similar stories, that suggests that KBR has required binding arbitration on over 300,000 incidents in the time frame. Given a theoretical 10 year block of time, that turns into about 100 binding arbitration events per day.
I would be very surprised if the US Military had an average of over 100 cases of non-judicial and judicial proceedings and decisions a day. Of those non-judicial proceedings are significantly more likely to be considered similar to binding arbitration. Additionally NJD is offered as an alternative to Judicial proceedings, not required and a judicial hearing having to be fought for.
I don't think KBR is anywhere near the size of the combined forces of the US Military, which suggests that arbitration hearings are happening far more frequently than they need to be.
Yes, I'm playing fast and loose with these numbers. In the vast majority of situations where binding arbitration does apply, Situations such as what was experienced by Ms. Jones would have been covered under civil and criminal statutes, and this would _not_ have even been considered for binding arbitration. If that 99.999% statistic quoted is meant to mean all binding arbitration applied in all situations, including for example the contract you may have agreed to with your cell phone, exactly how many situations of one in 100,000 does this suggest are this severe, or worse.
The use of statistics in this case is vastly misleading in both extremes, and it should have been recognized immediately by the lawyers involved that a situation of this nature does not fall within contract law, and should not have been handled by a binding arbitration.
