In exchange for his silence, Libby was promised that he would never see jail time, even if he lied to the jury (convicted). 5 hours after a judge ruled Libby could not remain free on appeal, Bush, after briefly consulting with Cheney, commuted his jailtime. So essentially, Bush is an accessory to obstruction of justice.

So the right wing should stop lying about her not being covert. Speaking of lying, Libby was convicted of lying and OBSTRUCTION OF JUSTICE, which means that according to a jury, not "people on the left," Libby willfully committed perjury to prevent someone higher up from getting busted. The fact that Bush pardened him a mere 5 hours after it was revealed he would have to do time suggests strongly that he made a deal.

Once he is pardoned, he is no longer in danger of incriminating himself, so he can't use the fifth amendment as an excuse not to testify. Since it is in Bush's interest that Libby not testify, he hasn't given Libby a full pardon.

- 3adkied, on 10/11/2007, -0/+2The serious crime is leaking a secret agent's identity (endangering them, any of their associates, and all the work they had done), that was committed by Someone (we're not sure who did or more importantly who told them to). The investigation wasn't able to come up with a strong case against Someone because of Libby's lies and omissions, which is illegal. They tried and convicted him for his crimes in undermining the investigation.
The main problem is that normally a person such as Libby would be granted some immunity by the judge in return for honest testimony against those who committed the serious crime. The problem is that in this case since those who may have been charged with the serious crime, the Bush Administration (or one or more people in it), also have the power to grant immunity in the form of a pardon, or in this case commutation of this sentence. The entire reason Libby was charged with obstruction of justice, perjury, and making false statements is because his lying caused the investigation to dead-end. He effectively blocked the investigation, because there's not enough evidence to convict Armitage, and certainly not enough to convict Rove, and Fitzgerald knows it. Also, why did Rove, the friggin' political advisor know about a CIA operative? That's where suspision gets cast on Bush and/or Cheney, especially since Cheney's chief of staff "took one for the team."
