Gonzales says the Constitution doesn't guarantee habeas corpus

sfgate.com — Gonzales acknowledged that the Constitution declares "habeas corpus shall not be suspended unless ... in cases of rebellion or invasion the public safety may require it.'' But he insisted that "there is no express grant of habeas in the Constitution.

  • populist, on 10/12/2007, -0/+3wrong. The Constitution guarantees nothing. What is does do is limit the powers of government - as made clear by the tenth amendment. Since the Constitution doesn't give the government the power to suspend habeas (unless..in cases of.....rebellion or invasion) - then it can't do it. period.
