They twist the word of God and use it as a way to spread hate and not love. They judge others and refuse to mourn with those who mourn as the Bible instructs us to do. Groups of people have done the very same thing throughout the history of Christianity, but that doesn't mean it represents the truth anymore than terrorism represents the truth of Islam. I applaud the courts for siding against the Westboro Baptist Church, whose mission it was to cause emotional "pain and suffering" in the same way that yelling "FIRE!" in a crowded theater is aimed at causing physical suffering. What is unfortunate is that the Westboro Baptist Church is garnering so much attention. It's a few dozen people, made up mostly by a single family of horribly misguided people. Here is some truth about Christianity: "Love is patient, love is kind. It does not envy, it does not boast, it is not proud. It is not rude, it is not self-seeking, it is not easily angered, it keeps no record of wrongs. Love does not delight in evil but rejoices with the truth. It always protects, always trusts, always hopes, always perseveres." 1 Corinthians 13:4-7.

That's why it's illegal to yell fire in a crowded theatre when there's no fire. If nothing else, they were disturbing the peace and possibly inciting a riot. But this wasn't even a criminal case, it was a civil case, so no one said what they did was illegal.

Freedom of speech is not enforcable in any private organization. This judgement was for "invasion of privacy and emotional distress". It has as little to do with freedom of speech as a judgement for slander would.

But you also can be held liable for defamation and libel as well both intentional and negligent infliction of emotional distress. I wouldn't be so sure the appeals court will feel this is protected speech.

Speech that is intended arouse violence, incite hate, or is incendiary is NOT protected by the first amendment. Hence the term "fighting words." Judge not, lest you be judged! You quote from Matthew 13:41-42, 50 -- an excellent scripture. It's how Jesus instructed his disciples to spread the Gospel, (the good news that He had died on the cross for our sins). Did Jesus instruct his disiples to scream at the sinners? Did he instruct them to fight them in fleshy, worldly, angry ways. No. He simply told them to offer them the gospel and if they accpeted it, to remain; and if not, depart. Find me the place in the Bible where it tells you to go to a person's funeral and cast judgement on them? To cause them pain and suffering? Tell me how Jesus reacted to the thief who mocked him on the cross. Did he scream at him? No. He didn't defend himself at all. Christ's instructions to us are simple, to love God with all our hearts and to love others as ourselves. Matthew 12:36-40: "Teacher, which is the greatest commandment in the Law?" Jesus replied: " 'Love the Lord your God with all your heart and with all your soul and with all your mind.' This is the first and greatest commandment. And the second is like it: 'Love your neighbor as yourself.' All the Law and the Prophets hang on these two commandments."

Fred Phelps was a civil rights lawyer before being disbarred and a life time Democrat who was an Al Gore fund raiser in the 80s and long time Gore supporter. The Westboro "Church" is comprised mostly of some 60 family members (he's got something like 13 kids himself) and is located at his home, and a good lot of these family members are lawyers themselves. The man spends about 150 thousand a year to travel to gay/lesbian events, funerals, and national disasters acting as a caricature of an extremist far right Christian religious group. He's doing this for one of two reasons (or maybe both). Either he's inciting violence towards himself and his family in order to sue the hell out of any one who takes a punch or sue a city for preventing him from protesting in the hopes to make big big money (the "church" films all protests and is very professional and careful in how it goes about the protest in order to ensure the most exposure in the least amount of time and inciting anger without doing anything illegal). The more outrageous reason he may be doing this (and i personally believe this to be true) is that he's actually purposely working towards advancing gay rights by victimizing homosexuals and throwing anti-gay rights activists (and Christians) in as dark a light as possible by association. This would follow in step with the civil rights work he was committed to before being disbarred.
