Everyone at a podium doesn't fight nearly as hard as Dodd or Kucinich to stop this nonsense from taking place. Hopefully Dodd will say his piece and there won't be a quick vote to end his filibuster.

Conversely, the Court has approved routine warrantless seizures, for example "where there is probable cause to believe that a criminal offense has been or is being committed."
It's from wiki and well, I know how inaccurate the thing is. - h3lx, on 01/24/2008, -1/+4The law states you get a warrant, you can get one retroactively over a select number of days... the only reason not to obtain a warrant is that the activity fails to meet the criteria necessary to obtain a warrant... searching without a warrant is illegal and a violation of the 4th Amendment.

Dodd makes excellent points, the biggest being that they can pass the FISA enhancements WITHOUT turning a blind eye to the (probably) illegal assistance from AT&T et al.
Oh, and for the confused people wondering about "retroactive warrants", etc., I suggest brushing up on FISA:

Under FISA, top secret warrants were perfectly available, even available AFTER wiretapping had already begun. But as far as we know, the warrants were never applied for. (Who knows, maybe they were told "no".) I haven't heard any defense as to why the executive branch and telecoms circumvented the judicial branch, as was laid out by the legislative branch with this law. - lrdntwnd, on 01/25/2008, -0/+2The Bush administration already has immunity.
