What he means by WE is the house of representatives, and he's describing the situation in the government right now regarding the bailout. The whole speech is directed to the house, not the American people. The speaker of the house cannot declare martial law, (I believe) only the president has that power. That said, an Army brigade is being deployed within our boarders to 'quell domestic unrest'. If they act against U.S. citizens, that would really be martial law.

Same piece of legislation made the hoarding of gold illegal, meaning you could not have more than your wedding ring or you will be sent to prison for 5 years or a fine of $10,000.00.
