Telecoms are required to comply with legal requests - they do not have an option to refuse to cooperate. Morover, just last month Justice Department audit revealed that "telephone companies have cut off FBI wiretaps used to eavesdrop on suspected criminals because of the bureau's repeated failures to pay phone bills on time. " Bush will scare you into that people will die the moment he does not get the power to spy without warrant but telecoms? They get a free pass.

Constitutionally, we are entitled to sue the government, but somehow the government is granting an outside entity with the ability to evade lawsuits? How can the government give others powers that they themselves don't posses? If they can do that, they can just appoint an outside organization every time they want to do something unconstitutional. He is also leading the push for verifiable ballots for elections. When I lived in NJ I was proud that he was my Congressman. The House needs to stay strong and not give in on immunity.

The case is filed for a federal District Court, then Appeals Court. If the Appeals court doesn't uphold the decision of the District Court, then the case is put into a pool of cases to be considered by the Supreme Court. If the SC agrees to hear the case they grant it a writ of certiorari.
Some cases involving disputes between states or matters of federal importance (like presidential elections, Gore v Bush) may go directly to the Supreme Court.
But if I'm not mistaken the Supreme Court doesn't need to be formally petitioned to challenge the constitutionality of a law passed by congress and approved by the president. The bill is still being debated, so after it's all been voted on and it eventually is signed by Bush, we might still see signs of principle in DC if and when the SC gets involved in overturning this atrocious bill. Given this court's track record, I wouldn't count on it though.
