All that is needed to be an enemy combatant is the president's opinion that you have provided material support to terrorists. The American Fascist Party is already saying that if you oppose current policy with regard to Iraq you are encouraging the terrorists. Not a big step from there to becoming a enemy combatant by opposing, or simply not supporting the government policy.

That was only after a formal declaration of war is declared by Congress. This was never done for Iraq/Afghanistan.
