Mr Habib was released on 28 January 2005 on the basis that there was insufficient evidence to lay charges against him.
Mr Hicks pleaded guilty to the charge of providing material support for terrorism at his arraignment before a military commission on 26 March 2007. He was sentenced to seven years imprisonment, of which all but nine months were suspended.
