Sanford was neither living together with this woman nor, as far as we know, having carnal intercourse with her in the state of South Carolina. State law applies only within state boundaries. Therefore, unless it can be proven that he had adulterous relations with the woman inside of the state, his confession of adultery does not make him automatically guilty in the eyes of the court. If you go to Amsterdam and smoke a joint, you can't be charged for it in South Carolina, even when you come back and tell everybody you did.
Of course, he did confess to an affair. It could be argued that he still committed a crime if the carnal intercourse was 'habitual' -- however I doubt that even South Carolina can successfully try and convict an individual based on events that occurred in Argentina, outside of state jurisdiction. - manjas8, on 06/25/2009, -2/+37Probably never, which would be the right amount of times it was actually enforced.
