One of the great things about being a lawmaker is that you are technically beholden only to your constituents. They could have come forward with this information at any time and the Bush administration would have been completely unable to physically stop them. Elected representatives are not granted security clearances, they are granted access based on their position, so they couldn't be prosecuted for coming forward. Plus, there are whistleblower protections for anyone else who had decided to come forward, since these activities were illegal.
One of the worst parts of our political system is that the opposition party has no incentive to hold the other party accountable. I'm sure the Democrats in this meeting were just as eager to endorse the program as their Republican counterparts, because someday the presidency would fall back into their laps and they they'd have the same powers as Bush to steamroll their opponents.
