- Napoleone, on 10/10/2007, -4/+270This is a hard issue, with no simple solutions, until you realize that sex is not the worse thing that could happen to a person (barring disease or unwanted pregnancy).
The first thing to do is to stop equating sex with rape. Rape is an ASSAULT that merely involves sex. An assault is an attack; something done to someone else AGAINST THEIR WILL. If the person welcomed the sex; guess what, they weren't assaulted.
At some point in time we're going to have to wake up to the fact that these laws are increasingly becoming more concerned with legislating morality, rather than justice.
FTA: "But competence isn't just cognitive. It's emotional, too. Steinberg reports that on tests of psychosocial maturity, kids are much slower to develop. From ages 10 to 21, only one of every four young people scores at an average adult level. By ages 22 to 25, one in three reaches that level. By ages 26 to 30, it's up to two in three." -
This is true. I call this the Disneyfication of western culture. The unnatural extension of the ignorance of youth.
There's a distinct difference --which modern western culture is loath to accept-- between a, say, 14 year old girl who's had sex, likes it and pursues it; and another girl of the same age who reluctantly explores such things as a result of undue persuasion. These things need to be judged case by case, and all factors should be objectively considered, or we're going to keep condemning people under a one-size fits all legal code that throws the book at humans for being humans in pursuit of mutual pleasure.
FTA: "The lowest standard is whether the partner you're targeting is sexually developed as an object. If her body is childlike, you're seriously twisted. But if it's womanly, and you're too young to think straight, maybe we'll cut you some slack."
This is disagree with. What does the body have to do with anything? The mind is what matters, in the end. Or is a man who pursues a 23 year old woman who looks under-age a criminal? We have to realize that an attraction to ANYTHING is not a crime. There are no thought crimes. Only actions matter.
FTA: "And if I ran a college, I'd discipline professors for sleeping with freshmen. When you're 35, "she's legal" isn't good enough."
Alright Ahmadinejad, here's a question. If a 17 year old girl has sex with a guy her age, on Monday... where is the crime in her having sex with a 50 year old man on Tuesday?
A lover is a lover. As soon as you can take on one, all others are allowed. The choice is yours. Period. The only difference the girl in the above scenario is likely to encounter is differing sexual prowess and the need for a blue pill. Sex is sex is sex, with whomever you have it. If you feel you're ready for it, go out and get.

At the end of the day, those who are abused for real need help. And those who hurt them should be taken care of. But we also shouldn't throw common sense out the window. - tastypickles, on 10/10/2007, -2/+105Issues like this make me glad I'm not a law-maker. Or 17.
- inactive, on 10/10/2007, -20/+102Let's not ignore the role feminists have had in making these laws.
Most are designed to make criminals of men while portraying the equally culpable female as a victim. The result? Men in prison. Girlies go free.
Genarlow needs his ass spanked for doing what he did and so does the girl. But prison????...and only for him????
Only a lesbian feminist would think that's a good idea. - Buddhist, on 10/10/2007, -2/+71I believe this thread has just been won.
- Napoleone, on 10/10/2007, -17/+78.
- IllBeBack, on 10/10/2007, -0/+54I wish I had been having oral sex when I was 15...
- theinept, on 10/10/2007, -2/+54Lots of way-too-subjective stuff going on in that article for it to be of value. I'm not even sure it made a salient point, although I guess we can all agree that putting a 17 year old in jail for getting head from a 15 year old is absolutely insane.
- scout29c, on 10/10/2007, -3/+52A big part of the problem is our bodies are design to begin having sex in our early teens. That was OK when life expectancy was 30 and you had to get on with your life because it was half over when things started budding out on you.
But that's not the case now. We expect our kids to wait until they are way past the age when nature comes knocking to even think about engaging in a sexual relationship. What would this world be like if just like riding a bike or fixing your own sandwich, it was perfectly acceptable to begin having sex as soon as you are able?
How much of our world's problems can be laid at the foot of suppressed sexual need? Maybe the whole pedophile thing would go away – but I doubt it. I believe the laws against having sex with minors should be adjusted for the age differential. Sex between kids only a few years apart in which one has just become an adult in the eyes of the law is a whole nother thing than some 30+ year old having sex with someone under age – especially if the kid is pre-pubescent.
While I wouldn't want my kids to do it, I sure did want to do it – or at least thought I did – when I was under age with a loaded gun hanging between my legs. I thought of little else.
And when I finally did get all I wanted, sex was no longer that important. Funny, as long as you are getting it on a regular basis, it's not all that life controlling. I could'a been a contender. - inactive, on 10/10/2007, -12/+57I understand a 19-year-old having sex with an 18-year-old, but a 18-year-old having sex with a 17-year-old? Well, that's just sick!
A law, is a law, is a law. - treed, on 10/10/2007, -4/+44Well, I'd discipline the professors too, but not because of the age difference, but for the conflict of interests.
- TheZorch, on 10/10/2007, -2/+37Do like the Japanese do, set the legal age of consent to 14 and be done with it.
- DarkStalker, on 10/10/2007, -1/+35Agreed. Next, it'll be illegal for them to simply kiss if there's more than a year age difference.
- donkevin, on 10/10/2007, -2/+36Yes, this is something so rarely seen on digg. I like to call it EPIC-WIN.
- inactive, on 10/10/2007, -1/+34I believe you.
The problem presents itself when you see a girl who's under 18 and looks around 25. How would you know unless you carded them....and would you ever do that? When I was 24, I picked up in a bar one night. I even saw the girl's ID as she was getting a drink. It said she was 25. Hell, I thought I was getting someone older than me.
As we were headed to the beach to "talk", a pack of her friends spotted her and came over. To her (and my) horror, they started talking about school.........long story short........she was 16 and had a mature look and fake ID.
That scared the ***** out of me, and she was supremely pissed that I walked off. I could easily be where Genarlow is today and through no fault of my own. I want to see that kid released. - bloodinmystool, on 10/10/2007, -1/+30Enjoy prison.
- heartcoldfusion, on 10/10/2007, -0/+28Alright. Enough. Just ***** combine digg and reddit already.
- Andelstein, on 10/10/2007, -0/+27I'm glad I'm not the only one who sees it like this. A couple months ago now, my girlfriend's parents found out we'd had sex. She's 16 and I'm 18. They firmly believe that turning 18 is crossing some sort of magical barrier and that she is still a "child" for not having crossed that magical barrier. By that logic, anyone that has sex with a minor even just 1 day under 18 is committing some sort of unspeakable crime.
I can't be sure of the connection here, but her mom's been throwing around the statement that I forced her to have sex with me. Which is the equating sex to assault thing you just mentioned.
Again, I'm glad there's some hope for logic and reasoning out there. - slofut, on 10/10/2007, -0/+26Can I subscribe to your newsleter?
- DJNewStyle, on 10/10/2007, -2/+27You may as well post it about every other year you've lived.
- wynja, on 10/10/2007, -0/+24The point is some 22 year olds are not mature enough for sex, and some 15 year olds are. The cookie cutter approach to justice is a bad idea. Mandatory minimum sentences are ridiculous in consensual sex cases, since the maturity of the individual parties is of primary concern (e.g. a 19 or 20 year old being labeled a sex offender for life for sleeping with a 15 or 16 year old girl is retarded, since truthfully they are likely to be around the same maturity level).
- Jugalator, on 10/10/2007, -2/+25The interrobang! A rare sight indeed.
- Otto, on 10/10/2007, -0/+23No, it means that the 25 year old girls all try to look like they're 16. Makes it hard to tell by comparison.
- Jugalator, on 10/10/2007, -1/+23Agreed, this makes me speechless too.

- Fluffiness, on 10/10/2007, -0/+19I kind of like the absurd simplicity of this statement.
- Napoleone, on 10/10/2007, -0/+19"And I can tell, too, when I'm looking at her, if she's over 18 or not, and thusly determine whether to be attracted or not. Really."
Most attractions are involuntary. Especially those having to do with sex. And those that aren't, are mostly informed by experience (good or bad), and take root at the subconscious level.
The reason you feel you can shut off-and-on your attraction for a female based on the magic number 18, is because that number's been drilled again and again into your head so much that you've internalized it to the point where it's become an ideological pheromone to you. The process by which that's happened is unnatural. - donkevin, on 10/10/2007, -2/+20I see what you did there.
- lukifer, on 10/10/2007, -4/+21Underage consensual sex should be defined as its own crime, without the word "rape" attached, and with a measured, appropriate punishment.
(Men also need a new social mechanism that allows asking for a girl's ID without seeming like a complete *****. We all know teenage girls lie.) - wynja, on 10/10/2007, -0/+17Yeah, there is no way to determine age from looks alone. That's why most states require you to ID someone for beer and cigarettes no matter how old they look. I've hit on 14 year olds that looked like they were 25 (imagine my surprise when she called me sir and I told her I was not much older than her and she said she was 14 and I walked away feeling like a dirty old man), and I've slept with 22 year olds that looked like they were 12 (yeah, I know. it was weird, but we had actually been friends since she was 12 and she hadn't changed at all).
I'm going to have to call BS on this post. - satx, on 10/10/2007, -9/+26 ?

- iceschade, on 10/10/2007, -0/+14They feed off each other... It's kind of fun to watch. Reddit gets a story, then Digg gets it... Digg gets a story then Reddit gets it...
The fun part is when Digg gets a story, Reddit clones it, then someone from Digg clones it again... Like the twenty thousand announcements of the Ubuntu Gutsy Beta release. - BobOki, on 10/26/2007, -4/+18There was an article just awhile ao about how men are criminialised, yet females are confused.
I am sorry, but in my world a man having sex with a 6 yr old girl or a woman having sex with a 6 yr old boy is the same, ilegal and molestaion/rape. Why can the woman "be in love" and the man not? Why can the woman "be confused" and he man not? Why can the woman get off charges with therapy and minor jailtime for these reasons, yet the man cannot?
Are litle girls SOOO much more fragile than little boys? Studies say no.
All in all? Women are ***** hypocrites when it comes right down to it. Equal rights and pay, but not equal punishments. - Otto, on 10/10/2007, -5/+19$

- billmccartney, on 10/10/2007, -0/+11Actually all congress can really do is regulate interstate commerce, but I digress... Your idea is pretty insane. You are basically demonizing sex. Try parenting your own kids if you want them to make good decisions, instead of hoping the government or society to raise your kids for you!
