If they wanted to advertise this movie during a campaign, then they could no longer enjoy their tax-exempt status, as they are not a political action committee.

The issue with this movie is a little more complicated in that it is being treated as an electioneering communication so it basically was subject to the same regulation as campaign commercials.

The issue is whether or not it constitutes a campaign ad, and should therefore be subject to both campaign finance laws and equal time provisions imposed by the FCC.

The right threw McCain-Feingold at Michael Moore for advertising Fahrenheit 9/11, but since Bush was not running in any primaries or caucuses, he was free to advertise the movie until within 30 days of when Bush became an official candidate (the Republican Convention). Before that ban was triggered, Moore began advertising F9/11 without any depiction or mention of Bush in the ads.
Citizens United (the producers of this movie) would have been free to advertise this movie at any point on any broadcast, so long as their ads did not mention or depict Hillary Clinton. You might think they shot themselves in the foot by calling it "Hillary: The Movie," but getting this case to go to the Supreme Court was their goal all along. - prophet5, on 03/26/2009, -3/+5Where were these idiots when they were making movies about George W. - sugarazor, on 03/26/2009, -0/+1That's quite a stretch to make there. And W. wasn't really much of an attack on Bush, so I don't see how you could say it's an attack on McCain. The movie was way more about Bush the man than his policies, so I don't think anyone in their right mind would interpret that movie as some sort of political vehicle for the Democrats. If you wanted to draw comparisons to Bush and McCain, all you had to do was use actual facts and footage, which Obama and the DNC did in their actual political ads.
Hillary: The Movie, was not blocked. They were free to produce it, release it and sell it, they just couldn't advertise it during the campaign. And it's not even that they couldn't advertise it, they just couldn't mention Hillary Clinton by name or show depictions of her in their advertising. Free speech was hindered in the case of this movie. That is the issue. It should have been allowed to be released whenever. No restrictions. Although the content of the Hillary movie pretended to be factual, while the Palin one obviously was satirical only, I'd rather not have a court engage in content-based analysis. For me, the determination of whether this is campaign material subject to McCain-Feingold should be based on how it was marketed: sold as a product or handed out as campaign literature. And sugarazor above makes a good point: non-profits who engage in political campaigning should lose their tax-exempt status. Otherwise, they simply become money laundering operations.

So, really, it was as close to an attack on McCain as you could get without technically attacking McCain. The only way I could see blocking this movie in any form, would be if the information was completely incorrect, and deceptive. But, from what I have heard and read, more people learning the truth about Hilary is somethign that her campaign should have been very afraid of.
