Uhmm, let's read this literally folks, without the hyperventilation. Note she said "unable to speak..." She did not say "not allowed to speak..." or "waterboarded until he could not speak..."
I haven't been to jail, but I have dealt with lawyers. If, in fact, he has been denied permission to speak to his counsel then that would be a violation of law, it would be a big deal, his lawyer would take it personally, and no one could even think of getting away with it. Publishing something like that would get a reporter promoted and believe me, there's nothing a reporter likes more than to be promoted, and nothing worse than a lawyer taking something personally.
*Much* more likely is that his attorney has been unavailable to speak with him since the hearing for an unrelated reason. On another case, out of town, or hitting the links. But "Keith and his lawyer haven't been able to hook up since the hearing," doesn't make nearly as good a story as all the thoughts that it seems they want to pop into our heads when they say "unable to speak...(wink)."

They didn't like the guy because (from what I understand) he made it his mission in life to criticize them, show up at their events holding pickets, etc.
I kow a lot about scientology as I grew up in southern california and hung out on Hollywood blvd in te late 80s often buying records, etc near their center there and they woluld always bring me and my friend in, get us to watch movies, etc. They weren't so bad, and the people I met there were nice, but they very much had this glow of roboticness about them - I can;t explain it.
I had a friend who was a scientologist who had some very bad experiences of the type you commonly heqar about, and I have read and studied up on what they do, and how their organization works.
Personally I don't know if people like Tom Cruise believe all that Xenu ***** - I kind of think that the actors like having an organization where they all get together - it;s like a networking thing on some levels - they have their private church/club and get some psychology out of it (i am sure they would hate anyone using that word, but the auditing process is similar to counseling in some ways)....It's kind of known as being helpful to yor career if you are a celebrity of a certain level and want to meet and get in with cliques of people.

And no judge in his right mind would proceed if the circumstances surround this lack of communication were valid. The judge would simply order a postponement of a week to allow for a proper communications to take place. If not, then the lawyer has good grounds for an appeal. Sure, this doesn't help the guy in jail immediately, but it will definitely work itself out in the long run.
