You don't have to declare war. International tribunals don't play the semantics game. Like the way Vietnam is officially a "diplomatic intervention".
And even if they avoid the war crimes accusations, crimes against humanity accusations are still valid and equal.

Another BTW -- the "FISA" law just passed conflicts with this judge's opinion -- this judge has got kahuna's...
