During the Civil War, the American people were in a state of rebellion. We are not in a state of insurrection or invasion right now by any force, so suspending Habeas Corpus is unconstitutional. And don't give me some line about "We're at war with the terrorists," since if we suspended Habeas every time a band of criminals killed a few thousand people, we might as well never have the writ since drunk drivers kill tens of thousands of people every year.
