It's possible that the disk creates a legal loophole for them, assuming that the language in the initial contract says something about "diskless" service.

I regularly shop at beatport to get my electronica fix that I can't get elsewhere and yeah.. I get a little annoyed when I try to put a track in my cart only to be rejected with a message stating "this is not available in your territory". I don't whine to beatport about it though. I did send off one email stating don't show me the content if I can't buy it after I log in. Eventually the track will be sub licensed out to another label with rights to sell in NA.

- geodebug, on 10/26/2009, -5/+19Don't know. Xbox doesn't need a disk, Netflix just came as a free downloadable app that pluggs into the dashboard. This has to be some kind of stop-gap. The whole "so each person wanting to use Netflix...will have to have their own disk" doesn't make sense. Roku, my blue-ray player, and xbox 360 all don't have this restriction.

Not only does every other application work on a bring-your-own-internet manner, but so does every other console. I'll be damned if I have to pay $300 for a console and still pay annual fees to use it to its fullest.
- mfaith, on 10/26/2009, -2/+16The 'initially' is the key. Rather than waiting for a nice firmware implementation, this is just a quick fix to get it working. I'm sure a firmware update in a few months will integrate a nice UI. Account association shouldn't be an issue, it would be handled just like the Roku players are today. When you first hook up the Roku device it registers its S/N with your account online. So I imagine the same or similar process would link your PSN id to your account.

"Initially, watching movies instantly streamed from Netflix via the PS3 system will be enabled by a free, instant streaming Blu-ray disc that is being made available to all Netflix members."
Two things jump out to me:
1. The word "Initially". That sounds like they have a plan to build it in to the PS3 OS, but for now the work around is a Disc.
2. I would be SHOCKED if there wasn't a hack available within a few weeks that allowed you to copy the Netflix app from the Disc to the hard drive. -
