As for the legality of this - I was going to reply straight up that this is illegal, but when I tought it through, I think this maybe is in a grey area. AFAIK, the law (USA's at any rate) allows one to have the ROM of game / program for backup purposes, so, as long as the owner of the site owns all the games he makes available through the site, I don't think he is in the wrong because he is not making the ROMs themselves directly available, but only the result of the emulation of the content of these ROMs. - picklepants, on 10/12/2007, -7/+2$10 each.

So...if you were to make a private emulator site, where you could play your own backup roms, and limit access to yourself, THAT would be okay.

Thanks for the clarification, but I think that I'd still stand by my point, and even your explanation is open to more than one interpretation. Namely, how do you define "use" of the back-up copies? The backup copies of the ROMs, by themselves, are useless. You need a way to process / play them - in this case, either a console or an emulator. Thus, he's not distributing the backup copies themselves, he's making available a way to play the product of the emulation - technically speaking, you're just playing a Java game on his site - you don't have access to the "data" the "Java game" uses to work, which in this case, happens to be ROM copy of the original game.
Anyway, IANAL, and I'm not saying what he does is legal, but maybe, as I said on my previous post, this falls on a grey area. - mattym, on 10/12/2007, -1/+3@cronot:

There really is no question here on copyright infringement. VNes, no matter how cool or awesome, is seriously infringing upon
many copyrights. Emulation, in a personal situation, may fall in a grey area. This does not.
If you still don't understand: the java emulator downloads a copy of the rom from VNes's server, and loads it into memory/caches
it to the user's HDD. VNes is distributing copyrighted material, regardless of whether the end user every actually "sees" the file

You see roms aren't illegal as long as the games are out of production and you delete them off your computer after 24 hours. The only thing is that people don't. This site is kind of the same principle except you can't delete it. They might regulate it by only allowing you to activate a game for 24 hours and prevent you from playing it for like a week or something. Also Vconsole is ridiculous, I thought those damn games were supposed to be free when they announced the Wii. Oh well what you gonna do about it I guess?

ROMs are not time-limited to 24 hours. They are legitimate backup copies IF AND ONLY IF they are intended for backup use. Technically, the ROM files themselves may not be used; the data is supposed to be restored to the proper medium (ie, Nintendo cartridge) before use. Hence the term "backup."
The 24 hour thing is just an urban myth intended to legitimize ROMs. It doesn't matter how long you have the ROM, it matters *how you use it.*
Many of the IP owners haven't enforced their rights and challenged emulators, ROM sites simply because it wasn't worth the money. (Notable exceptions: EA, Square Enix, Sega) Now that old games are becoming popular again on the Wii and Xbox Live, you can expect that to change in the next year or two, as companies revive their interest in old IP.
[ And BTW, abandonware is not a recognized legal concept. While there is a statute of limitations for specific copyright violations (meaning that they couldn't sue Person A for copying a game in say, 1990), the IP owner doesn't relinquish their rights to the IP unless they voluntarily do so. (trademarks are the exception; trademarks are lost if not actively protected). So they could always sue Person C for copying a game in 2007. ]

If you have a hard copy of a game and make your own backup, that is legal. It's not legal, however, to share that file. Or include it with other emulators. And, it's even not legal to download someone else's backup copy. Only if you make your own backup of your own game. So although I'm a HUGE supporter and lover of emulation, it's not exactly legal.

Sharing *your* physical copy of the game is legal.
Distributing copies of the game are not.
Just recognize that there is a cost-benefit analysis here: companies won't just sue Joe Schmoe for sharing a few ROMS; the game industry was built on shareware. The companies only pursue serious offenders, like some of the bigger ROM sites a few years back (which EA and Square Enix successfully shut down as they cropped up).

Really garbled sound and the game isn't picking up that I'm pushing the enter button, in both IE and Firefox. It makes me sad because I want to play SMB3. Flying with a raccoon tail always did it for me.
