To classify a 14- or 16-year-old male as a "child" in one set of laws because it involves sex with an adult, then to classify the same 14- or 16-year-old as an adult because they are involved in another type of crime, is ludicrous.
OK, so you will argue that in one instance the child is a victim, while in the other he or she is the perpetrator. that is the epitome is situational or circumstantial morality. So these kids grow up to think that one set of rights and wrongs apply if you are a victim, but another completely different set of rights and wrongs apply if you are the perpetrator.
Adults are more responsible than children, or should be. But that only supports my initial point - that you are either a child at 14 or 16, or you are an adult, but with our current set of laws and societal mores, you can be either. no wonder there is a 10-year-old boy who is gender confused out there who wants to use the girls' bathroom because of his lack of gender identity - society has created these confusing systems, labels and situational morals and circumstances that lead to these types of problems. - Curlz31, on 01/09/2008, -2/+127Remember, it's only a crime if she's ugly.

Trying someone as adult involves proving they had the mental capability to think for themselves like adults. An older person is almost all of the time mentally capable of thinking like an adult, but a younger child is not.
If a child is mentally capable of being a sexual aggressor, and it is proved he is a sexual aggressor in a case, he'd could be tried as an adult. If a child is mentally capable of committing murder, and it is proved he committed murder, he can be tried as an adult. In this case, it is very likely that the sexual aggressor is not the child, and that the teacher was not intimidated into sending naked photos to the child. The teacher was and adult and was more aware that the age difference was wrong than the child was, and more aware that children are not able to legally consent.

Second, On this particular one the teacher seems like she was the one keeping it going. She was the one that was making sure that this could continue. If it had been the student that was keeping it going then different.
Third, Freshman in high school are more than capable of decisions. Maybe not the best of ones at times but they know what they are getting into. I mean when I was a freshman in high school I was already being forced to start choosing career paths, Look at colleges, Prep for SATs and what not, etc. etc.. With the hormones raging at that time, I know I'd consider taking the opportunity if a reasonably hot twenty-something year old teacher would be hitting on me.
So I have to wonder if the boy actually want her jailed for what she did here? Or is it just society that wants it? It always feels kind of wrong with society interfering with these laws when both are happy with it. Children involved be damned.
