- SublimeRuin, on 12/18/2008, -7/+733Update: This is from the officers' lawyer, William Helfand:
Both the daughter and the father were arrested for assaulting a peace officer. "The father basically attacked police officers as they were trying to take the daughter into custody after she ran off."
Also, "The city has investigated the matter and found that the conduct of the police officers was appropriate under the circumstances," Helfand says. "It's unfortunate that sometimes police officers have to use force against people who are using force against them. And the evidence will show that both these folks violated the law and forcefully resisted arrest."
-- Chris Vogel
Really!? They WRONGFULLY apprehend someone but yet their conduct was appropriate?
Quick! What would you do?
3 guys jump out of a van at your daughter, cover her mouth and drive off with her.
A- Try and stop them.
B- Call the Police while trying to stop them.
C- Do nothing, There must be a perfectly good explantion for this!
D- SHOOT THEM! (They should be happy this guy didnt have a gun...) - JBSchweitzer, on 05/29/2009, -2/+578He was plain clothed, in a van, and strangling a 12 year old girl....
Yes. Blame the girl...... - PhoebusCartel, on 12/18/2008, -6/+411The court just said the police were acting appropriately. So if three men jump out of a van to grab a 12 year old girl the appropriate response is to assume they're police officers??? Maybe if they offered her free candy she'd be more willing to go?
- Observant1, on 12/19/2008, -1/+358One of them grabbed her saying, "You're a prostitute. You're coming with me."
sounds more like a desperate paedophile than a cop, as well as being domestic terrorism. - holyskeleton, on 12/19/2008, -2/+298"Dymond, an African-American, was a hooker due to the "tight shorts" she was wearing, despite not fitting the racial description of any of the female suspects. The police went to the wrong house, two blocks away from the area of the reported illegal activity"
Damn those ***** are retarded. - feelmypimphand, on 12/19/2008, -1/+289D - Shoot Them
3 Men in plain clothes jumping out of a van with their hand over my daughter's mouth.
Shoot them dead. - NiNiCraftOne, on 12/18/2008, -3/+261Keep your daughters away from Galveston! I was going to go to Texas to get away from the cold Canadian weather this winter but won't be visiting Galveston.... I've got a 10 year old daughter who's not a prostitute and I'm not sure her shorts would pass muster with the Galveston cops!
Bunch of ***** idiots running that town.... - rubberpants, on 12/19/2008, -1/+224Being a cop means never having to say you're sorry.
- Scrappy1850, on 12/19/2008, -2/+183d
- inactive, on 12/19/2008, -3/+180I can find, just from the report....the following charges against ALL officers involved as well as the chief of police.
*Attempted kidnapping
*Endangering the welfare of a minor
*Trespassing
*Criminal Trespass with intent on abducting a minor
*Simple Assault
*Criminal Negligence for not checking and then DOUBLE CHECKING their intended target.
The cops should consider themselves lucky that no one got their head smashed.....I would not convict any of them. If I were the judge, it would get kicked out of my court so fast, they wouldn't know what happpened
I think that they should hang for their actions. and afterwards the parents should sue for no less than 9 digits - trigger119, on 12/19/2008, -1/+171"Also, The city has investigated the matter and found that the conduct of the police officers was appropriate under the circumstances"
Maybe in Bizarro-retardland. This is seriously an effed up story. They are lucky her Dad didn't have a gun- he would've been justified in shooting them. Why?
1)Unidentified men in plainclothes
2)Rolled up in a van
3)Abducted his daughter
Anyone else thinking those cops got lucky the father wasn't packing heat? - davidg11, on 12/19/2008, -5/+172I call ***** on this story. If this really happened, every 24 hour news channel would be covering this.
Oh wait, the girl was BLACK....ok, move along, nothing to see here.
The media only focuses on cute white girls. - kd420, on 12/19/2008, -2/+161Horrible story. If I was one of those cops I'd be pleading with the family for forgiveness, not charging them.
"...despite not fitting the racial description of any of the female suspects..." It seems to me that it would be pretty easy to differentiate a black person from another race. Secondly, there should be no reason for the girl to get injured from the encounter. She is 12, and I know it can't be that hard for THREE grown men to restrain her without beating her. And why did they have to be in plain clothes if they were just going to run out and grab her? Where is the need to be subtle?
Their story makes absolutely no sense, and to me it seems as though they were racists out to harass a black child. They should be convicted of assault/excessive force and the department should be sued. - seanstuart, on 12/19/2008, -1/+157According to this defense, once cops apprehend you (mistakenly or otherwise, they have free license to do whatever they want to you - beat the living ***** out of you, but if you run/resist/fight back in anyway, YOU'RE the criminal.
- bullhead2007, on 12/19/2008, -1/+152You forgot one important detail here too.
Non-uniformed, plain clothed, officers can assault anyone at any time and if they defend themselves they are resisting arrest and assaulting an officer.
Basically if anyone ever attacks you, don't ever fight back, because who knows if they are a cop or not. - lightningbolt, on 12/19/2008, -2/+139All police forces should start implementing a minimum IQ requirement for new hires to prevent ***** idiots like these from assaulting more people. They should fire all who don't meet the requirement.
- haikuFU, on 12/19/2008, -0/+124Anyone trying to abduct my child from my yard is getting shot. If you're on my property and threatening me or my family in anyway, the guns are coming out.
Those cops are lucky they were not shot, plainclothes and assaulting a kid? That father had every right to shoot first and ask questions later. Additionally, it worries me that the cops were supposed to be looking for white prostitutes 2 blocks away, and they tried to abduct a 12 year old black girl. What were their real intentions? Did they honestly think she was a prostitute, or was there something more sinister going on? I'm willing to bet the latter. - Hillsfar, on 12/19/2008, -1/+115Especially considering they were PLAINCLOTHES officers. They didn't have a squad car nor badges. How is the father to know? If I were a lawyer, I'd represent the girl and her daddy pro bono!
- AleaIactaEst, on 12/19/2008, -4/+117More Police-State brutality.
- Jaleho, on 12/19/2008, -0/+112Unfortunately, they do just the OPPOSITE, denying people jobs as police officers because their IQs are too HIGH:
http://query.nytimes.com/gst/fullpage.html?res=9A0 ... - aggiejaa, on 12/19/2008, -1/+96Gotta wonder how this story would have played out if it were a 12 year old white girl that the cops picked up.

The government is the terrorist. - orangetiki, on 12/19/2008, -0/+74I own a gun, and trust me I would NOT have been hesitant to open fire.
- goffy59, on 12/19/2008, -0/+71We live in a police state. It gets worse every year.
- inactive, on 12/19/2008, -1/+70There is no fate too unpleasant for the person, or people, who went ahead with pursuing the "assaulting an officer" charges. Those police officers are lucky to be alive.
- Elsewhere42, on 12/19/2008, -2/+71Can anyone find the full names, addressed and phone numbers of those cops?
Lets see what happens when that is posted on the internet. - maz2331, on 12/19/2008, -0/+66Sadly, in most states, the law is that resisting even a blatantly illegal arrest is a crime in and of itself.
- DistantSecond, on 12/19/2008, -2/+63Even if you don't know you're being arrested. Sounds like fascism to me.
- humanjhawkins, on 12/19/2008, -1/+60Crap... If this happened at my house, there would be more than one dead person on my lawn... Probably one of them being me after these thugs returned fire.
Cops need to learn that they can't have it both ways. Either you are a hero that risks your own safety to make sure that innocents are not hurt, or you are just a hired gun pushing people around at the orders of your superiors.
The trouble today is, cops claim they have to do all sorts of bad things (like punching a girl in the face and throat) in order to keep themselves safe. But then they turn around and expect people to think of them as heroes.
Sorry, most of them are just hired thugs. Please DON'T vote for any bill or levee that increases funds to police departments. If every police department in the nation was cut in half, we would be a much better society. - identitymatrix, on 12/19/2008, -0/+59Here's the lawsuit: http://www.courthousenews.com/2008/08/26/Galveston ...
Their names are:
SERGEANT GILBERT GOMEZ [BADGE #987]
OFFICERS DAVID ROARK [BADGE #332]
JUSTIN POPOVICH [BADGE #336]
SEAN STEWART [BADGE #392]
Galveston Police Department's Website:
http://www.galvestonpd.com/ - jcaino, on 12/19/2008, -0/+57Did they read the Miranda rights or anything? No, they just grabbed the girl...that's not an arrest in any sense of the word, that's just an abduction.
- Atertract, on 12/19/2008, -1/+57Some of those injuries sound like they were beating her just because they're cops and they like to beat people unnecessarily.
- CylonsOfTheLamb, on 12/19/2008, -0/+56Shoot them, beat them, cut pieces from their bodies, drag them behind my truck around the block a few times, then line them up in a row and hop on the john deere lawn tractor.
- graham3000, on 12/19/2008, -1/+57Did anyone see the Reno 911! where this happened. I hope the police don't continue to mimic the fine officers of Reno.
- inactive, on 12/19/2008, -0/+55This happened to me about four years ago. I wasn't assaulted, but I had two guns and a taser pointed at me. They had the wrong house and kicked down my door. The crackhouse they were looking for was two blocks away. Luckily, I didn't get roughed up too bad, other than jerked around a bit while they cuffed me.
They paid to get a new front door installed. - jcaino, on 12/19/2008, -0/+54D - All. Day. Long.
- atroxodisse, on 12/19/2008, -0/+52There'd be three dead cops if it was my daughter.
- cowboy86, on 12/20/2008, -0/+51 I really hope they're not serious in saying that it was justified because there is a huge amount of case law dealing with just this acrossed the United States. As well as specific provisions in the bill of rights preventing an unlawful or unconstitutional arrest even if by means of deadly force.
"An illegal arrest is an assault and battery. The person so attempted to be restrained of his liberty has the same right to use force in defending himself as he would in repelling any other assault and battery.” (State v. Robinson, 145 ME. 77, 72 ATL. 260)
“Each person has the right to resist an unlawful arrest. In such a case, the person attempting the arrest stands in the position of a wrongdoer and may be resisted by the use of force, as in self- defense.” (State v. Mobley, 240 N.C. 476, 83 S.E. 2d 100).
“One may come to the aid of another being unlawfully arrested, just as he may where one is being assaulted, molested, raped or kidnapped. Thus it is not an offense to liberate one from the unlawful custody of an officer, even though he may have submitted to such custody, without resistance.” (Adams v. State, 121 Ga. 16, 48 S.E. 910).
“Citizens may resist unlawful arrest to the point of taking an arresting officer’s life if necessary.” Plummer v. State, 136 Ind. 306. This premise was upheld by the Supreme Court of the United States in the case: John Bad Elk v. U.S., 177 U.S. 529. The Court stated: “Where the officer is killed in the course of the disorder which naturally accompanies an attempted arrest that is resisted, the law looks with very different eyes upon the transaction, when the officer had the right to make the arrest, from what it does if the officer had no right. What may be murder in the first case might be nothing more than manslaughter in the other, or the facts might show that no offense had been committed.”
I hate how just because cops take some criminal law classes they think they know everything about the law and that everyone's guilty. The factor of the matter is, cops know the laws but fail to know and understand the case laws and how they apply to certain laws and how to enforce such properly. - inactive, on 12/19/2008, -10/+60Those cops should be killed, as publically and as spectacularly as possible.
- teraken, on 12/19/2008, -0/+47Mike, you're a complete and utter retard. If three un-uniformed men grabbed your 12 year old daughter and dragged her into a van, you'd let them drive off and "sort it out later"? Please, don't ever have children. Or better yet, remove yourself from the gene pool.
- spidur1, on 12/19/2008, -1/+47Jesus Christ, WTF?
Can you imagine how scared that 12 year old kid was? The cops are probably dumber than hell. Its not like they are trying to stop a cold blooded killer... Do they have any common sense at all? I hope this family wins big in court, these cops are retarded power tripping fools. And unlike many diggers, I like most cops but this is insanity. - SublimeRuin, on 12/18/2008, -6/+51Your comment is worthless....
- kismetropolis, on 12/19/2008, -0/+43Yes, it's so hard to see the difference between a black girl and a white one.
And a man acting to protect his child (as he should) is charged. The child acting in self defense (as anyone would) is charged.
What is wrong with this world? - AngelaQ, on 12/19/2008, -0/+43Actually, they figured that she was a prostitute, since she was a black female in shorts, so they were probably going to gang rape her, because that's what cops can get away with doing to sex workers.
- stoperror, on 12/19/2008, -0/+42It's a little different when there is no obvious sign the person(s) in question are officers, no?
- poptartrevival, on 12/19/2008, -2/+44I bet they saw something pretty on the street, and decided to have a good time with her. They didn't count on her actually having someone who cared about her fighting for her. How dare you fight the authorities? You're supposed to stay in your home when they're stealing people off the street, they know what's good for you!
- seanstuart, on 12/19/2008, -0/+42Another bad part is - say this dad did have a gun and used it on these guys who SHOWED NO SIGN of being cops. They probably would have fried him for being a cop-murderer.
Good to be a cop I guess:
1) Take off your badge and uniform.
2) Beat the ***** out of someone.
3) Charge them with assaulting an officer if they fight back. - BoneheadFarker, on 12/19/2008, -0/+39Who the ***** can't tell the difference an adult white woman and a black child?
