1) Consent to BAC test , knowing you're drunk and will probably fail and have to face the consequences.
2)Don't consent and they lock you up anyway because you refused to take the test. It is just like when they come to your house and ask if they can look around. They ask you more as a politeness more than you really having a choice. You absolutely have the right to refuse the test, but that doesnt mean it is a get-out-of-jail-free card.

- Asianwaste, on 11/04/2009, -0/+2I'm all for DUI regulation but I am not a fan of open container rules. It should be a welcome probable cause to test for DUI rather than an automatic charge for DUI. You are basically charging someone automatically for the POTENTIAL to commit a crime rather than for actually committing the crime itself.
Checking the alcohol levels on a driver has become so easy and accessible these days that we don't need this measure of enforcement. It's an overreaction for a time when it wasn't so easy to do this. It's outdated. Imagine being charged with the potential to commit assault simply because you're a gun owner even through you've never even aimed the gun at any living thing.

- Halsfield, on 11/05/2009, -0/+1My point with the line you quoted was that just like when they ask you to take a BAC test, you can refuse, but they'll still lock you up. Just like when they suspect you have something in your car or house and ask to search, you can refuse but they'll come right back and search it anyway because getting a warrant takes very little time. They are asking the first time out of politeness , more than you really having a choice of whether or not they will get to search your house.

You are completely wrong on this. YOU DO NOT have to let police come into your apartment. Ask them for a search warrant. If they do not have one, they have no right to enter unless they have "probable cause" for that some illegal activity is taking place, for example if they can smell marijuana or hear beating and screaming in the apartment.
