"Cruel and Unusual" punishment is intended to prevent drawing and quartering, torture, and the like, as was practiced in england, and was drawn directly from their bill of rights. As were other parts of the eight amendment, including excessive bail, excessive fines, and capital punishment.
The ambiguity of the clause is not intended to prescribe a prohibition of just punishment.
Keep in mind, that back then, the convicted often had ears cut off, were whipped, placed in stocks for days, etc. The eighth never came into play on those punishments. According to your argument, there are no possible cruel and unusual punishments. Hell, by that logic, if we were to take slow drowning in a pit of acid while having your fingernails torn out and your testicles gutted with a dull knife, and we were to make that policy, we'd be clear of the 8th.
Remember, it all starts with torturing and killing the most unpopular group of people imaginable (child molesters, terrorists, etc.) and expands outward. Don't be so quick to suggest we take yet another step down that path.

I don't have a link but years ago a rapist convinced a judge to castrate him instead of putting him in jail, saying that jail would never remove his urges to rape. The judge agreed but the guy eventually landed up raping an elderly woman with a broomstick handle!

I'm a big fan of the death penalty personally, I realize it is an overly simple solution in these complex times but if you have a murderer/rapist/pedophile, and a confession/dna evidence then why keep them around? Repeat offenders, however, deserve complete removal from society.

I was in a library in San Jose and there were two street people making out in the corner under a reading table on top of their shopping bags containing God-knows-what. I've been in the restroom of the same library and found another one of these model citizens with their shirt off, giving themselves a sponge bath at the sink. It's a known fact that a large number of the homeless have substance abuse/mental problems. Would you want your kid wandering into the library restroom with these characters on the loose? Not me.
I'm thankful that I live in the 'burbs now, and the local library isn't inhabited by the sort of riff-raff that frequent the urban branches, however they've been replaced by another sad testament of our modern society - the noisy cellphone gabbing teenager.

All prisoners carry papers on them. These papers contain the usual ID type stuff, but it also contains info on the crimes committed and why they are there. Of course due to politics, other prisoners force the newbies to show their papers, if the person refuses, it is assumed they are a child molester or a rapist. Either way, they become the ***** of the *****.
In fact, he even told me of a particular prisoner who is in prison because a man raped and killed his son, and for revenge the guy killed him. Now he is in prison for life, but it gets better. He has dedicated his life in prison to killing other pedophiles in prison. So he kills one, goes into solitary confinement for a couple years, eventually gets worked back into the prison society, and then kills again. Turns out, this "judge" was appointed by a former Republican governor, Jane Swift, who apparently was quite liberal in her views and policies. I really don't get why people are so bothered by people politicizing these sorts of things. Are you suggesting that we just sit back and let these sort of things happen? The only alternative that doesn't involve hoping he drops his soap is getting the government to place a mandatory life sentence on a convicted sex offender, or some other serious punishment. That can only ever happen if people start getting candidates into office who will work for that sort of thing, and the only way to do that is to "politicize" things like these. To be honest, I'd consider a candidate who places things like this at the front of his plans a whole lot more than one who drones on about drugs and terrorism.

Sounds to me like he's not just willy-nilly letting perverts out of jail. Maybe he is following the law.
The question is: what should the law be? Just throwing these guys in jail forever is not the answer. Either choose the death penalty, attempt rehabilitation, or hope that time in prison becomes a deterrent. If you try rehabilitation, you are not going to have a perfect record. I think even a truly just society still has some risk associated with it.

To that end it should be disposed of as quickly and efficiently and cheaply as possible. Torturing it serves no purpose. I see no need to waste tax money keeping the trash alive so it can suffer. If the evidence against the trash is indisputable, once it's fairly convicted in court, just take it out, put a bullet in its head, and dispose of the carcass.

Sadly its the same in the medical world as well with psychiatrists. People just bypass psychiatric advice and instead seek out answers from medical doctors. One of the main reason some psychological disorders were being over diagnosed (ADHD, Depression, ect..) was because medical doctors were diagnosing everyone who complained of symptoms rather than sending their patients to psychologists.
